HomeMy WebLinkAbout1986-08-27; Planning Commission; Resolution 2602"8 1 2 3 4 5 6 7 8 0 0 PLANNING COMMISSION RESOLUTION NO. 2602 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM NO DESIGNATION TO TRANSPORTATION CORRIDOR (TC) ON PROPERTY GENERALLY LOCATED WITHIN THE ATCHISON TOPEKA & FREEWAY. APPLICANT: CITY OF CARLSBAD CASE NO: zc-349 SANTA FE RAILROAD RIGHT-OF-WAY AND THE 1-5 , i WHEREAS, a verified application for certain property has been filed with the City of Carlsbad, and referred to the Planning Commission; and 9 10 11 WHEREAS, said application constitutes a request as 12 13 14 15 16 provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 13th day of August, 1986 and on the 27th day of August, 1986 hold a duly noticed public hearing as prescribed by law to consider said request; and 17 /I WHEREAS, at said public hearing, upon hearing and l8 I considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors 19 I relating to the Zone Change; and 20 21 NOW, THEKEFORE, BE IT HEREBY RESOLVED by the Planning 22 23 24 25 Commission recommends APPROVAL of ZC-349, based on the beneficial to both the City and the community. 27 26 Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the following findings and subject to the following conditions: Findings: 1) That a Transportation Corridor (TC) Zone is necessary and 28 .I 0 e 1 2) 2 3 4 5 6 7 3) 4) That a Transportation Corridor (TC) Zone will ensure that the right-of-way needed for light-rail transit is provided to accomodate regional transportation planning efforts in the future. That high-intensity development will not occur in the railroad right-of-way, thereby, precluding future light-rail transit, That this project will not cause any significant adverse impacts on the environment because a Negative Declaration was issued by the Planning Director and approved by the Planning Commission on August 27, 1986. 8 1) Approval shall be granted for the area shown on Exhibit "A", g Conditions: dated July 29, 1986, attached hereto, and incorporated herein. lo li PASSED, APPROVED AND ADOPTED at a regular meeting of the 71 A" IPlanning Commission of the City of Carlsbad, California, held on I.2 II the 27th day of August, 1986, by the following vote, to wit: 13 I AYES : Chairman Schlehuber , Commissioners: Marcus, 14 McFadden, Schramm, Holmes & Hall. 15 1 ABSTAIN: None.
