PLANNING COMMISSION RESOLUTION NO. 2602
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CHANGE FROM NO DESIGNATION
TO TRANSPORTATION CORRIDOR (TC) ON PROPERTY
GENERALLY LOCATED WITHIN THE ATCHISON TOPEKA &
FREEWAY.
APPLICANT: CITY OF CARLSBAD CASE NO: zc-349
SANTA FE RAILROAD RIGHT-OF-WAY AND THE 1-5
, i WHEREAS, a verified application for certain property
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and 9

11 WHEREAS, said application constitutes a request as

provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 13th day of
August, 1986 and on the 27th day of August, 1986 hold a duly
noticed public hearing as prescribed by law to consider said
request; and
17 /I WHEREAS, at said public hearing, upon hearing and
l8 I considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors 19 I
relating to the Zone Change; and 20
21 NOW, THEKEFORE, BE IT HEREBY RESOLVED by the Planning

Commission recommends APPROVAL of ZC-349, based on the
beneficial to both the City and the community. 27

Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
following findings and subject to the following conditions:

1) That a Transportation Corridor (TC) Zone is necessary and

That a Transportation Corridor (TC) Zone will ensure that the right-of-way needed for light-rail transit is provided to accomodate regional transportation planning efforts in the future.
That high-intensity development will not occur in the railroad right-of-way, thereby, precluding future light-rail transit,
That this project will not cause any significant adverse impacts on the environment because a Negative Declaration was issued by the Planning Director and approved by the Planning Commission on August 27, 1986.
