APPLICANT: OCEAN STREET CONDOS CASE NO: v-375 WHEREAS, a verified application for certain property, to 7 IFit: 8 9 10 ll Lots 19 & 20 in Block "H" of the Hayes Company Addition to Carlsbad, Map No. 2, in the City of Carlsbad, County of San Diego, State of California, according to Map 1221, filed in the office of the County Recorder of San Diego, November 4, 1909, 11 ll has been filed with the City of Carlsbad, and referred to the 12 I1 Planning Commission; and 13 II WHEREAS, said verified application constitutes a request 14 \I as provided by Title 21 of the Carlsbad Municipal Code; and 15 Ii WHEREAS, the Planning Commission did on the 17th day of 16 IF eptember, 1986, hold a duly noticed public hearing as prescribed I.7 Ir y law to consider said request; and 18 II WHEREAS, at said public hearing, upon hearing and all 19 1 estimony and arguments, if any, of all persons desiring to be eard, said Commission considered all factors relating to the ariance; and 2o s 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 22 23 c ommission as follows: 24 25 26 (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, the Commission APPROVES V-375, based on the following findings and subject to the following conditions: 27 ll//// 28 .I/// -+- a 0 1 2 3 4 5 Findings 1) That there are exceptional or extraordinary circum- stances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone, for reasons stated in the staff report.
