A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAilLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF SPECIFIC PLAN 200, FOR A 187 ACRE 38-LOT INDUSTRIAL PARK LOCATED ON THE NORTH SIDE
OF PALOMAR AIRPORT ROAD, BISECTING THE FUTURE EL FUERTE STREET.

Planning Commission; and

provided by Title 21 of the Carlsbad Municipal Code; and
'VJHEREAS, the Planning Commission did, on the 17th day of
SEPTEMBER, 1986, hold a duly noticed public hearing as prescribed
by law, to consider said request; and
WHEREAS, at said public hearing, upon hearing and consider-
ing all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to the
Specific Plan; and

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning. Commis-
sion as follows:
(A) That the foregoing recitations are true and correct.

(B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of SP-200, based on the
following findings and subject to the following conditions:

I) The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate industrial development at the density pro-
posed.
2) The project is consistent with all City public facility
policy and odinances because the Specific Plan prohibits any development on the site without the proper public improvements.
5 3) The proposed use will not be detrimental to adjoining properties for the reasons identified in the staff report. 6

7 in conjunction with previously certified environmental documents and a notice of Prior Compliance has been issued by 8

the Planning Director on August 23, 1986 and approved by the
Planning Commission on September 17th, 1986.

and with Sections 65451 and 65452 of the Government Code which

regulate the use of specific plans.

CONDITIONS:
1) Approval is granted for the attached ordinance, attached as

Exhibit "A", , dated September 8, 1986, incorporated by
reference and on file in the Planning Department. Development

shall occur substantially as shown unless otherwise noted in these conditions.

entitled "Carlsbad Airport Business Center Specific Plan",
18 dated September 8, 1986, and incorporated by reference, shall be met by any future development occurring within the boundaries of this Specific Plan.

3) This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on April 22, 1986 and any development fees
established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to
improvement plan and to fulfill the subdivider's agreement to
pay the public facilities fee dated September 10, 1986 and the
agreement to pay the Growth Management Fee dated September 10, 19136, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project shall be void.

This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer capacity is available at the time of application for such permits and will continue to be available until time of occupancy.
Pretreatment of the sanitary sewer discharge from this project is required. In addition to the requirements for a sewer
connection permit the developer shall conform to the
requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste discharge
permit concurrently with the building permit for this project.
No Certificates of Occupancy for the project will be issued
before the industrial waste discharge permit application requirements have been met, all applicable fees paid and the permit is sued.
The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies
regarding services to the project.
Prior to issuance of any building permit, all public improvements as required by Carlsbad Tract 74-21 shall be installed. This shall include all Loker Avenue to join Palomar Airport Road to the East and to the West.
Sidewalks constructed to City standards shall be located on
both sides of Loker and El Fuerte Streets prior to occupancy of any buildings.

City Engineer prior to occupancy of any buildings.

14) All graded areas shall be hydroseeded when required to the
satisfaction of the City Engineer.
15) All structures shall conform to all FAA regulations and to
the McClellan - Palomar Airport Comprehensive Land Use Plan.
16) Before and as a condition of obtaining a final map, or final development permit or site plan approval under Title 21 of the
Carlsbad Municipal Code, the subdivider shall enter into a
contract with the City whereby the subdivider covenants on behalf of the subdividers and subdivider's successors in
interest to the following:
a) No opposing and consenting to the formation of a bridge and major thoroughfare district for the southern area of the City.
b) Payment of the bridge and major thoroughfare fee for the area of the district in which this development is located.
c) Payment of the traffic impact fee established for the area of the City in which the development is located.
Fire Department:
17) Prior to issuance of building permits, the developer shall submit to the Fire Department a map, showing the street network, conforming to the following criteria:
* 400' scale (1:4800) * Photo reduction on mylar * At least two existing streets and/or intersections shall be referenced on the map (not a separate vicinity map) * Maps shall include at least the following information:
-k Street centerlines * Street names * Fire hydrant locations
18) The applicant shall agree to pay a fee established to cover
the cost of updating Fire Department response maps.
