APPLICANT: COLLEGE BUSINESS PARK CASE NO.: CT 85-17 WHEREAS, a verified application for certain property to wit: Parcels 1 through 4 of Parcel Map No. 6331, in the County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, September 8, 1977 as File No. 77-369645 of Official Records, has been filed with the City of Carlsbad, and referred to the 1 Planning Commission; and I ~ MIEREAS, said verified application constitutes a request l3 14 as provided by Title 21 of the Carlsbad Municipal Code; and 15 WHEREAS, the Planning Commission did, on the 17th day of September, 1986 and on the 1st day of October, 1986, hold a duly 16// noticed public hearing as prescribed by law to consider said I? 11 request; and I% /I WHEREAS, at said public hearing, upon hearing and I' 11 considering all testimony and arguments, if any, of all persons "I/ desiring to be heard, said Commission considered all factors 21 11 relating to the Tentative Tract Map. 22 ll NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 23/( Commission as follows: 24 25 26 27 the Commission hereby APPROVES CT 85-17 based on the 2 8 IM A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, following findings and subject to the following conditions: 1 2 3 4 5 6 7 8 9 1.0 1.1 1.2 I. 3 1.4 I. 5 I. 6 1.7 1.8 1.9 I i! 0 i! 1 i!2 ~ i! 3 2! 4 2! 5 2! 6 27 28 I ~ e 0 Findings : 1) The project is consistent with the 'City's General Plan since the proposed industrial subdivision is consistent with the Planned Industrial designation for the site as indicated on the Land Use Element of the General Plan. 2) The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate industrial development at the intensity pro- posed. 3) The project is consistent with all City public facility pol- icies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, ensured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that building permits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. b) All necessary public improvements have been provided or will be required as conditions of approval. c) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the I General Plan. i d) Assurances have been given that adequate sewer for the project will be provided by the City of Carlsbad. This EIR 81-9 was certified by the City Council on September 21, 1482. The EIR identified a number of potentially significant impacts created by the project and possible mitigation measures to reduce these impacts to a level of insignificance. These mitigation measures have been incorporated into the Specific Plan (SP-199) for the property, and in some cases, the project has been revised to reduce all impacts to a level of insignificance. The specific findings for the Planning Commission on each identified impact are attached as Exhibit "D" and incorporated herein by reference. 6) This project requires the construction of the improvements or facilities listed in the conditions of approval or the payment of fees in lieu of construction. This project creates a direct need for the improvements or facilities for the reasons stated in the staff report. If the improvements or facilities are not provided the project will create an unmitigated burden on existing improvements and facilities. Further, the improvements and facilities are necessary to provide safe, adequate and appropriate service to future residents of the project consistent with City goals, policies and plans. 7) The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has.agreed to abide by any additional requirements established by a development management or public facility program ultimately adopted by the City of Carlsbad. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project. Conditions: I l) !PE,ll roval is granted for CT 85-17, as shown on Exhibits "A" on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. , dated September 5, 1986, incorporated by reference and 2) This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. ///I PC RES0 NO. 2579 -3 - :1 :2 a I ~ ~ 0 I) I 4) Prior to approval of the final map for this subdivision the developer shall demonstrate adequate sewer capacity will be available, or propose mitigation measures to guarantee sewer service availability to this site. The above mentioned sewer study and mitigation measures shall be approved by the City Engineer. 4 5 6 7 8 9 10: 11 12 13 1.4 1.5 1.6 1,7 5) This project is also approved under the express condition tha the applicant pay the public facilities fee adopted by the City Council on April 22, 1986 and any development fees 1 established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or .other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfill the subdivider's agreement to pay the public facilities fee dated September 18, 1986 and the. agreement to pay the Growth Management Fee dated September 10, 1986, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project shall be void. 6) Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983. 7) The applicant shall comply with all provisions of the Carlsbad Municipal Code Section 21.90.030 (Growth Management System). 8) Approval of this request shall not excuse compliance with Specific Plan 199, all section of the Zoning Ordinance and all other applicable City ordinances in effect at the time of building permit issuance. Said site plan shall be submitted to and approved by the Planning Director prior to the issuance of building permits. 11) The applicant shall establish a property owner's association and corresponding covenants, conditions and restrictions. All approved landscaping for special landscaped streets, the par course and open space/passive recreation park shall be installed prior to the occupancy of each phase. All approved landscaping shall be installed prior to the occupancy of any building per each phase of development. A 500' scale map of the subdivision shall be submitted to the Planning Director prior to the recordation of the final map. Said map shall show all lots and streets within and adjacent to the project. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All development shall be required to be kept outside of the identified 4.1 acre open space area identified within the northwest corner of the property on Exhibit "C". Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and approved specific plan, and shall require review and approval of the Planning Director prior to installation of such signs. A uniform sign program for this development shall be submittec, to the Planning Director for his review and approval prior to occupancy of any building. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. 21) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction ofi the Directors of Planning and Building. 22) The applicant shall submit a street name list consistent with the City's street name policy subject to the Planning Director's approval prior to final map approval. //// I l!d/-rbESO NO. 2579 I -5- :L :2 :3 4 5 6 7 8 9 10: 11 12 13 14 15 1.6 1.7 1.8 1.9 I 210 2! 1 i! 2 2! 3 2! 4 i! 5 2! 6 27 2! 8 0 '0 23) The project shall provide bus stop facilities at locations subject to the satisfaction of the North County Transit Dis- trict. Said facilities shall at a minimum include a bench, free from advertising, and a pole for the bus stop sign. The bench and pole shall be designed in a manner so as to not detract from the basic architectural theme of the project and said design shall be subject to the approval of the Planning Director and North County Transit District. 24) The project shall attempt to develop a ride to work and home I program for its employees with the North County Transit Dis- trict. Furthermore, the project shall attempt to limit the staggering of worker shifts so as to facilitate the success 0:: said program. 25) Approval of Tentative Tract No. 85-17 is granted subject to approval of Zone Change 331. 26) Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/o:: . addresses shall contrast to their background color. 27) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project ar challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this. approval shall be invalid unles the City Council determines that the project without the condition complies with all requirements of law. 28) All buildings including their roof top equipment and landscaping shall comply with all FAA rules and height requirements as well as the requirements of the McClellan - Palomar Airport Land Use Plan (CLUP). 29) Approval of this tentative tract map shall expire twenty-four months from the date of City Council approval unless a final map is recorded. An extension may be requested by the applicant. Said extension shall be approved or denied at the discretion of the City Council. This condition shall apply to that portion of the project located within the tentative map. I1 flight path restricted use zone'' as identified on the 31) All development proposed with this project shall comply with all design guidelines and development standards of Specific Plan 199. 32) All development upon the subject property shall comply with the slope and resource preservation policies of the underlying Mello 11 Local Coastal Program. 33) The landscape plan as proposed is specifically not approved. Prior to final rnap approval the landscape plan shall be revised to comply with the design of the tentative map and the landscape standards of Specific Plan-199. This revised landscape plan shall be subject to the approval of the Planning Director and the Director of Parks and Recreation. Engineering Department: 34) Pretreatment of the sanitary sewer discharge from this project. is required. In addition to the requirements for a sewer connection permit the developer shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste discharge permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued before the industrial waste discharge permit application requirements have been met, all applicable fees paid and the permit issued. (A note to this effect shall be placed on the final rnap. ) 1 35) No grading permits shall be issued for this subdivision prior to recordation of the final map, unless specifically approved by the City Engineer. No final map shall be issued until the applicant has obtained all applicable coastal permits. 36) This project lies within the boundaries of the coastal zone, consistent with the City's LCP, no grading shall be permitted during the rainy season (October 1 to April 1). Prior to issuance of a grading permit the applicant shall submit a grading schedule including a contract showing compliance with grading restrictions. 2 7 37) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 228 PC Mso 1\10. 2579 -7 - .I/ I1 I 0 a :L :e 3 14 38) The grading for this project is defined as "controlled grad- ing" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall Se to coordinate site the approved grading plan, submit required reports to the Cit Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. ~ inspection and testing to ensure compliance of the work with I .5 39) 6 '7 8 9 Upon completion of grading, the developer shall ensure that a.1 Engineer. This plan shall be signed by both the soils engineer and the engineering geologist. The plan shall be prepared on a mylar or similar drafting film and shall become a permanent record. I1 as-graded" geologic plan shall be submitted to the City 10 11 40) No grading shall occur outside the limits of the subdivision unless a letter of permission is obtained from the owners of the affected properties. 12 13 41) The proposed grading concept is "balanced cut and fill earthwork for combined Phase 1 and Phase 2, no export or import grading activity is hereby proposed nor approved. 14 15 16 17 42) Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. I I.8 r 43) The developer shall exercise special care during the construction phase of this project to prevent any offsite siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention Engineer. The basins and erosion control measures shall be constructed to the satisfaction of the City Engineer prior to removal of any basins or facilities so constructed the area 23 served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or 24 approved by the City Engineer. The developer shall enter into a desiltation basin maintenance agreement and submit a maintenance bond satisfactory to the City Engineer prior to the approval of grading, building permit or final map whichever occurs first for this project. Each desiltation basin shall be serviced by an all-weather access/maintenance road. The provisions of may be utilized in the construction of this project as required by the City Engineer. The offer shall be made prior to issuance of any building permit for this project. All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. Engineer. Prior to approval of the final map, the Subdivider shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the tentative map and the following improvements to City Standards to the satisfaction of the City Engineer: a) Half width of Palomar Airport Road, including offsite transitions, utility relocations, offsite drainage improvements and full width median along the frontage of this subdivision (Phase 1 or 2). b) Full width improvement of College Boulevard onsite (An approved secured assessment agreement may satisfy this condition) (Phase 1 or 2). c) Half width plus 12 feet of Hidden Valley Road within a full width graded right of way. (Including approval of a feasible alignment study) (Phase 2). subdivision (within each respective Phase). 51) Improvements listed above shall be constructed within 12 d) All street, drainage and utility systems to serve this months of final map approval and/or improvement plan approval:, whichever occurs first. 52) Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this site plan. 53) All street systems proposed shall be public. 54) The developer shall install street lights along all public and private street frontages in conformance with City of Carlsbad Standards. The trees shall be of a variety selected from the approved Street Tree List. 56) The developer shall install sidewalks along all public street frontages of this project in conformance with City of Carlsbad Standards prior to occupancy of any buildings. 57) The developer shall install a wheelchair ramp at the public street corner abutting the subdivision in conformance with City of Carlsbad Standards prior to occupancy of any build- ings. SS) The developer shall comply with all the rules, regulations an( design requirements of the respective sewer and water agenciet regarding services to the project. Id/dESO NO. 2579 -10- 0 0 1 2 3 4 5 6 7 8 9 ILO :L1 60) Should the developer decide to final map and develop phases out of numerical sequence with the approved phasing as shown on the tentative map all conditions required of the precedeing; phases shall be completed. 61) The developer shall provide an acceptable means for maintaining the easements within the subdivision and all the streets, sidewalks, street lights, storm drain facilities and sewer facilities located therein and to distribute the costs of such maintenance in an equitable manner among the owners of the units within the subdivision. 62) All concrete terrace drains shall be maintained by the homeowner's association (if on commonly owned property) or the An appropriately worded statement clearly identifying the responsibility shall be placed in the CCSrR's. I individual property owner (if on an individually owned lot). 63) Access points shall be exactly as shown on Exhibit A, dated September 5, 1986. Minor changes to these access points may be approved by the City Engineer/Planning Director. :L 2 x3 :14 :15 1 6 17 18 19 I 20 21 22 23 24 25 26 27 28 I, 64) All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "No Parking/Fire Lane Tow Away Zone'' pursuant to Section 17.04.040, Carlsbad Municipal Code. 65) The Subdivider shall provide separate sewer, water, gas, and electric services with meters to each of the units. 66) The applicant shall agree to utilize reclaimed water, in Type I form, on the subject property in all common areas as approved by the City Engineer. 67) Irrigation systems to accommodate future reclaimed water shall r>e designed consistent with Title 17 of the California State Administrative Code. Offsite future reclaimed water distribution systems should be anticipated by the installation of adequately sized sleeves at crossing points to minimize street excavation. 68) Some improvements shown on the Tentative Map and/or required by these conditions are located offsite on property which neither the City nor the subdivider has sufficient title or interest to permit the improvements to be made without acquisition of title or interest. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. Additionally the firs sheet of each set of plans shall have the following certificate: I "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for this I project, that I have exercised responsible charge over the design of the project as defined in Section 6703 of the Business and Professions Code, and that the design is consistent with current standards. I understand that the check of project drawings and specifications by the City of Carlsbad is confined to a review only and does not relieve me, as Engineer of Work, of my responsibilities for project design. NO. # 70) The developer shall provide the City with a reproducible mylar copy of the site plan as approved by the Planning Commission. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer prior to improvement plan submittal. 71) Prior to approval of any grading or building permits for this project, the owner shall give written consent to the annexation of the area shown within the boundaries of the site plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1. I/// //I/ /I// ill1 PC RES0 NO. 2579 -12- /I 0 0 I :1 2 3 4 5 6 7 8 9 10 1.1 1!2 :L3 :L4 :I 5 :L 6 1 7 :L 8 :19 I 20 21 22 23 24 25 26 27 28 7 2) Before and as a condition of obtaining a final map, or final development permit or site plan approval under Title 21 of th Carlsbad Municipal Code, the subdivider shall enter into a contrace with the City whereby the subdivider covenants on behalf of the subdividers and subdivider's successors in interest to the following: I a) Not opposing and consenting to the formation of a bridge and major thoroughfare district for the area of the district in which this development is located. b) Payment of the bridge and major thoroughfare fee for the area of the district in which this development is located. c) Payment of the traffic impact fee established for the area of the City in which the development is located. 73) The alignment of Palomar Airport Road as shown on the tentative map is conceptual only. The specific alignment of Palomar Airport Road shall be approved by the City Engineer or through Assessment District proceedings prior to final map approval. Fire Department 74) Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. 75) Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. 76) The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. 77) An all-weather access road shall be maintained throughout construction. 78) All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. I 79) Brush clearance shall be maintained according to the specifications contained in the City of Carlsbad Landscape Guidelines Manual. 80) All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertment to the project shall be submitted to the Fire Department for approva: prior to construction. //// PC RES0 NO. 2579 -13- 0 0 :L :2 :3 <4 5 6 7 8 9 1.0: 1.1 1.2 1.3 1.4 3.5 I 6 It 7 IL a 81) Building exceeding 10,000 sq.ft. aggregate floor area shall bd, sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq.ft. The following items constitute the Planning Commission environmental findings for this project. The mitigation measures listed below have been incorporated into the proposed project over this property which reduce the identified impacts to insignficant levels. A, TRAFFIC CIRCULATION Impact: The project by itself, will not result in significant impacts to the traffic circulation system. However, traffic generated by approved and planned projects in the area will result in cumulative significant impacts to the circulation system, Mitigation: The proposed project will construct College Boulevard across the property and widen Palomar Airport Road and Hidden Valley Road adjacent to the property boundaries. The project will also signalize the intersections of Palomar Airport Road and Hidden Valley Road, contribute 508 of the cost of signalizing the intersection of Palomar Airport Road and College Boulevard, and participate in the City's bridge and thoroughfare district. Implementation of these measures will adequately mitigate all proportionate project traffic impacts. B. LAND USE Impact: Adverse impacts to land use include (1 ) compatibility with the proposed Macario Canyon Park, ( 2 1 potentially significant crash hazard and noise impacts associated with Palomar Airport and (3) non-compliance with Mello I1 Local Coastal Program resource preservation policies. Mitigation: Compatibility impacts associated with Macario Canyon Park have been mitigated through provisions of Specific Plan 199 which require that all industrial lots adjacent to Macario Canyon Park be fully landscaped along their perimete.rs, Potential noise and crash hazard impacts from Palomar Airport have been mitigated by conditioning through the Specific Plan that structures upon lots 19, 22, 23, and 2 4 be e 0 restricted to certain uses and lot coverages as follows: a) Warehouses - maximum 75% lot coverage b) Offices - maximum 35% lot coverage No storage or manufacture of explosives or highly flammable materials will be allowed on these lots. The Planning Director must approve all uses proposed on these lots. These provisions will adequately mitigate the identified land use impacts. Special construction measures have also been incorporated to mitigate internal noise to acceptable levels. The project as proposed has been redesigned to come into compliance with slope and resource preservation policies of the Mello I1 Local Coastal Program policies. C. AIR QUALITY Impact: Development of the property with industrial uses will result in an incremental addition to the regional emission of air pollutants. Mitigation: Project specific air quality impacts can be mitigated through the implementation of various air quality strategies including the use of carpools, mass transit and other industrial energy conservation measures as stated in the RAQS. Effective long term mitigation can only be accomplished on a regional basis, D. BIOLOGICAL RESOURCES Impact: Implementation of the proposed project would impact several areas of sensitive coastal sage scrub habitat located across the property. This impact would be significant in that it would continue to reduce regionally this sensitive wildlife habitat which is located within the coastal zone, Mitigation: The tentative map has been redesigned to maintain a 4.1 acre area of coastal sage scrub habitat in open space. Otherwise the project is in compliance with all Local Coastal Program sensitive resource policies. -2- e 0 E. TOPOGRAPHY AND VISUAL AESTETICS Impact: Impacts to landform will result from grading of the site into manufactured pads and slopes. These visual impacts will be significant to auto traffic along Palomar Airport Road. Mitigation: The tentative map has been designed to avoid large manufactured slopes along Palomar Airport Road. The slopes that will exist along Palomar Airport Road have been reduced to a maximum gradient of 3:l to soften their appearance. The other manufactured slopes along College Boulevard and throughout the center of the property have been undulated from 2:l to 3:l to accomplish this same affect. In addition these slopes wjll be fully landscaped to mitigate visual impacts of development. F. HYDROLOGY AND WATER QUALITY Impact: Project implementation will result in increased runoff, sediment load and altered chemical content of runoff. Mitigation: These impacts will be mitigated through the incorporation of detention basins and drainage maintenance program to remove debris from paved surfaces will be implemented to reduce chemical contaminants associated with runoff. .. facilities to control runoff. In addition, a G. GEOLOGY AND SOILS Impact: Development of the property could be impacted by potential hazards resulting from unstable soils, secondary seismic effects and erosion.
