HomeMy WebLinkAbout1986-10-01; Planning Commission; Resolution 26220 c x Ii PLANNING COMMISSION RESOLUTION NO. 2622 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION OF FIVE TEMPORARY MODULAR BUILDINGS ON PROPERTY GENERALLY LOCATED AT THE END OF IMPALA DRIVE, EAST OF PALMER WAY. WHEREAS, at said hearing, upon hearing and considering a 17 18 testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to CUP-295 19 jl NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 2o 11 Commission of the City of Carlsbad as follows: 21 ll A) That the above recitations are true and correct. 22 23 B) That based on the evidence presented at the public hearing, the Commission APPROVES CUP-295, based on the following findings and subject to the following conditions: 24 ll Findings: 25 26 27 28 1) That approval of the conditional use permit for the modular offices will not be detrimental to surrounding uses or to uses specifically permitted in the zone since the modulars will be used by City employees in providing public services to the citizens of Carlsbad. e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I! 20 21 22 23 24 25 26 27 28 2) That the site is adequate in size and shape to accommodate the use. 3) That all of the yards, setbacks, walls, fences, landscaping and other features necessary to adjust the modular office use to existing or permitted future uses will be provided and maintained; 4) That the street system serving the modular office use is adequate to properly handle all traffic generated by the proposed use, since the streets were specifically designed for this use. 5) This project will not cause any significant environmental impacts and Negative Declarations have been issued by the Planning Director on August 23, 1986 and September 20, 1986 and approved by the Planning Commission on October 1, 1986. Conditions: 1) Approval is granted for CUP-295, as shown on Exhibit(s1 , dated , incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. I 3 1 water shall be provided to this project pursuant to the water Service agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983. 4) The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. 5) A final site plan for the modular structures including placement, orientation and architectural treatment of buildings shall be submitted to and approved by the Planning Director prior to building permit issuance. 6) This conditional use permit shall expire five years from the date of this resolution or when permanent facilities are completed, whichever occurs first unless an extension is granted by the Planning Commission. //// //// //// PC RES0 NO. 2622 -2- I 1 e * 1 PASSED, APPROVED AND ADOPTED at a regular meeting of the 2 3 Planning Commission of the City of Carlsbad, California, held on the 1st day of October, 1986, by the following vote, to wit: 4 5 AYES: Chairman Schlehuber, Commissioners, Marcus, NOES: None.
