PLANNING COMMISSION RESOLUTION NO. 2629
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE DEVELOPMENT PLAN NO.
86-12, ELEVATION AND SITE PLAN APPROVAL OF A PREVIOUSLY APPROVED.SUBDIVISION FOR 73 SINGLE FAMILY DWELLINGS ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF ELM AVENUE AND EL CAMINO REAL. APPLICANT: RISING GLEN CASE NO. : SDP 86-12
WHEREAS, a verified application has been filed with the 6

City of Carlsbad, and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and

WHEREAS, pursuant to the provisions of the Nunicipal Code,
the Planning Commission on the 17th day of December, 1986,
con.sidered said request on property described as:
Lots 1 through 73 inclusive and Lot 75 of Carlsbad Tract 83-20, in the City of Carlsbad, County of San Diego, State of California, according to Map No. 11578 thereof recorded July 29, 1986, San Diego County.
15 WHEREAS, at said hearing, upon hearing and considering all

heard, said Commission considered all factors relating to Site 17
testimony and arguments, if any, of all persons desiring to be
19 1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

Commission of the City of Carlsbad as follows:
A) That the above recitations are true and correct.
22 B) ' That based on the evidence presented at the hearing, the
23 Commission APPROVES SDP 86-12, based on the following findings
and subject to the following conditions:

1) The project is consistent with CT 83-20 and meets all zoning
26 requirements of the R-A-10000 Q zone. I

2) The project is architecturally compatible and environmentally
integrated with the surrounding neighborhood. A variety of roof lines have been provided and views of existing property owners to the east have been maintained.
3) The project will not cause any significant environmental
impacts and a Notice of Prior Compliance has been issued by the Planning Director on November 12, 1986 and approved by
the Planning Commission on December 17, 1986.
Conditions:
n) APR,', roved is granted for SDP 86-12, as shown on Exhibits "Dl' , dated November 7, 1986, incorporated by reference and on file in the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these
conditions.
2) Approval of SDP 86-12 is subject to all conditions contained in CT 83-20.
3) The developer shall submit CCStR's to the Attorney's Office for
review. No changes may be made to the CCStR's without City approval.
4) To preserve views as much as possible, fences on the western property lines shall be limited in construction and materials
to those shown on Exhibit "I", dated November 24, 1986. This
condition shall be stipulated in the CCStR's.
5) Prior to the issuance of building permits, the applicant shall provide a revised landscape plan which shall be approved by the Planning Director. This plan shall preserve easterly
views from the existing homes located along the western
property line of the proposed project. Tree and shrub varieties shall be such species which at maturity, will not obstruct views from existing homes.

1.9 I 6) Lots 16-20 shall be limited in height to one story construction. The remainder of lots shall be constructed as indicated on the plans. XI I I 21 7)

The rear, "panhandle" portion of Lot 9 shall be landscaped
prior to the issuance of a Certificate of Occupancy for this lot unless the panhandle portion has been sold to an adjacent property owner.
All trees and vegetation planted west of Celinda Road shall be of a type or species which will not exceed 25 feet in height. This condition shall be reflected in the CCSrR's and the purchasers of lots in this are shall be notified of this condition at time of purchase.
