CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING DENIAL WITHOUT PREJUDICE OF A 31 LOT TENTATIVE
TRACT MAP ON PROPERTY GENERALLY LOCATED ALONG THE FUTURE EXTENSION OF FARADAY ROAD, EAST OF THE CARLSBAD PUBLIC SAFETY CENTER. APPLICANT: FARADAY BUSINESS PARK CASE NO: CT 85-12
6 I1 WHEREAS, a verified application for certain property, to

8 Portions of Lots "A" and 'lBrl of Rancho Agua Hedionda, according to Map No. 823, filed November 16, 1896, 9
10; has been filed with the City of Carlsbad, and referred to the

Planning commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 18th day of
February, 1987, hold a duly noticed public hearing as prescribed
16 llby law, to consider said request; and
17 I1 WHEREAS, at said public hearing, upon hearing and

considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Tentative Tract Map and Condominium Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
24 B) That based on the evidence presented at the public hearing, the Commission hereby recommends DENIAL WITHOUT PREJUDICE of CT 85- 12, based on the following findings and subject to the 25 following conditions:

Findings :
1. The applicant is not actively processing the proposed project. 1
2 2. The application for the proposed project is incomplete. A
3 Public Facilities Fee Agreement has never been submitted.

3. The proposed project has numerous unresolved Planning and

Engineering issues.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 18th day of February, 1987, by the following vote, to
wit: 9 AYES : Chairperson McFadden, Commissioners: McBane, 10 Hall, Schramm, Schlehuber & Holmes.

ABSENT: Chairman Marcus. 12
