PLANNING COMMISSION RESOLUTION NO. 2663
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN APPEAL OF DC 87-1 TO PERMIT A LARGE RESIDENTIAL DAY CARE CENTER ON PROPERTY LOCATED AT THE TERMINUS OF LA PORTALADA DRIVE AND
ADDRESSED AS 4104 LA PORTALADA.
APPLICANT: KATES
CASE NO.: DC 87-1
WHEREAS, a verified application for certain property, to
wit:
Lot 143, Unit No. 3, Map No. 8150,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 20th day of May
and the 3rd day of June, 1987, consider said request; and
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to the Day
Care Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
1A) That the above recitations are true and correct.
B) That based on the evidence presented at the hearing, the
Commission APPROVES DC 87-1, based on the following findings
and subject to the following conditions:

1) The property does have adequate ingress and egress to ensure
the safe dropping off and picking up of children as mitigated by the conditions imposed.

2) The center would not substantially increase traffic and parking problems on a low density, residential cul-de-sac street.
3) The center would be compatible with existing residential uses. The center, located at the end of the cul-de-sac would not be disruptive to the single family character of the street.
5 4) The play area for twelve children is adequate in size and as
6 mitigated would not cause adverse impacts to adjacent

This day care permit is issued for a period of one year. The Planning Department shall conduct quarterly reviews of the site to ensure that the conditions of approval are being adequately met and that the day care use is compatible with the surrounding neighborhood in terms of traffic, parking, noise, access and public safety and welfare. If at some point the Planning Director determines that problems in
these areas exist this day care permit shall be brought back
to the Planning Commission for review. At that time the
Planning Commission may add further conditions or may revoke
this permit. After ten months the applicant may request an extension of this permit from the Planning Commission in
one-year increments.
