APPLICANT: CARLTAS DEVELOPMENT COMPANY CASE NO. : SP-l9(C) I WHEREAS, a verified application for certain property, to 1 wit: .A portion of Lot H of the Rancho Aqua Hedionda, Map 823, in the City of Carlsbad has been filed with the City of Carlsbad, and referred to the Planning Commission: and WHEREAS, said verified application constitutes a request as provided in Title 21 of the Carlsbad Municipal Code: and WHEREAS, the Planning Commission did, on the 4th and on the 12th day of November, 1987, hold a duly noticed public hearing as prescribed by law to consider said request: and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commision of the City of Carlsbad, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of SP-l9(C) based on the ' following findings and subject to the following conditions: Findinqs: 1) The proposed Specific Plan is consistent with the General Plan since it implements the RRE (Extensive Regional Retail) land use designation specified for the site by the Land Use Element of the General Plan. //// 28 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 1 20 21 22 23 24 25 26 27 28 0 0 2) The site is physically suitable in size and shape to accommodate the permitted uses identified in the Specific Plan. 3) The Specific Plan will help mitigate impacts on this property from Palomar Airport by eliminating residential development as a permitted use. 4) The Specific Plan is consistent with the Carlsbad General Plan and with Sections 65451 and 65452 of the Government Code which regulate the use of specific plans. 5) The uses permitted by SP-l9(C) will not adversely impact public facilities in Local Facilities Management Zone 3 since the zone plan has been amended to address the minimal impacts created by development permitted by Specific Plan 19 (C) . 6) This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on September 11, 1987 and recommended for approval by the Planning Commission on November 12, 1987. Conditions: 1) Approval is granted for SP-19 (C) , as shown on Exhibit IrEl1 , dated November 4, 1987, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. 3) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance. 4) Specific Plan 19(C) is approved for application to all lots within the boundaries of the plan. Any adjustment of the boundaries of said lots and any subdivision of the existing lot or lots shall be performed subject to the terms and //// //// PC RES0 NO. 2692 -2- w ..
