II a e I 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 2707 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A REQUEST FOR A HILLSIDE DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED EAST OF PARK DRIVE, SOUTH OF CALAVO COURT, AND WEST OF PROPOSED SUNNYHILL DRIVE. APPLICANT: VON PACKARD CASE NO.: HDP 87-1 I t5 II WHEREAS, a verified application for certain property to I 711 wit: a 9 Parcel B of Parcel Map No. 12243 filed in the Office of the County Recorder of San Diego County, July 16, 1982, 10 11 has been filed with the City of Carlsbad and referred to the Planning Commission; and 12 WHEREAS, said verified application constitutes a request 13 1 Planning Commission Determination; and 19 be heard, said Commission considered all factors relating to the 18 all testimony and arguments, if any, of all persons desiring to 17 WEREAS, at said hearing, upon hearing and considering 16 December, 1987, consider said request; and 15 WHEREAS, the Planning Commission did on the 16th day of 14 as provided by Title 21 of the Carlsbad Municipal Code; and 20 Commission as follows: 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning B) That based on the evidence presented at the public hearing, 23 A) . That the foregoing recitations are true and correct. 22 the Commission DENIES HDP 87-1, based on the following 24 findings and subject to the following conditions: 25 and Design Standards of the Carlsbad Hillside Development 1. The proposed project does not attempt to fit the existing topography, but attempts to massively alter the site to fit a flat pad product type onto a steep hillside. b- The proposed Slopes on top of up to 22 feet high retaining walls will create an adverse visual impact on adjacent residences in the vicinity of Agua Hedionda Lagoon. c. Contour grading has not been utilized to provide a variety of both slope percentage and slope direction. d. The proposed dwelling unit has not been sufficiently setback from the adjoining downhill slope so that the visual impact on the surrounding neighborhood is eliminated or significantly reduced. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 16th day of December, 1987, by the following vote, to wit: AYES : Chairperson Marcus, Commissioners: McBane, Hall, McFadden, Holmes & Schlehuber.
