HomeMy WebLinkAbout1988-02-17; Planning Commission; Resolution 27121 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 2712 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.42, SECTION 21.42.010 OF THE CARLSBAD MUNICIPAL CODE BY THE DELETION OF SUBSECTION 21.42.010(6)(A), THE AMENDMENT OF TITLE 21, CHAPTERS 21.26 AND CHAPTER 21.28, SUBSECTIONS 21.26.015(5) AND 21.28.015(5) ALLOWING AUTOMOBILE LAUNDRIES OR CAR WASHES AS ADDITIONAL CONDITIONAL USES IN THE NEIGHBORHOOD COMMERCIAL (C-1) AND GENERAL COMMERCIAL (C-2) ZONES AND THE AMENDMENT OF TITLE 21, CHAPTER 21.29 SUBSECTION 21.29.050(1) TO ALLOW AUTOMOBILE LAUNDRIES OR CAR WASHES IN CONJUNCTION WITH SERVICE STATIONS AS ADDITIONAL CONDITIONAL USES IN THE COMMERCIAL TOURIST (C-T) ZONE. APPLICANT: CITY OF CARLSBAD WHEREAS, the Planning Commission did on the 17th day of February, 1988, hold a duly noticed public hearing as prescribed by law to consider said request; and CASE NO: ZCA 88-1 WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Code Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZCA 88-1, according to Exhibit I1A1l, dated February 17, 1988, attached hereto and made a part hereof, based on the following findings: Findinss: 1. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 17th day of February, 1988, by the following vote, to wit: AYES : Chairperson McFadden, Commissioners: McBane, Hall, Schramm, Holmes & Schlehuber. NOES : Commissioner Marcus. AN ORDINANCE-OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY AMENDING CHAPTERS 21.42 (CONDITIONAL USES) BY DELETING SECTION 21.42.010 (6) (A) WHICH ALLOWS CAR WASHES IN THE INDUSTRIAL ZONE AND BY ADDING SUBSECTIONS 21.26.015(5) AND 21.28.015(6) ALLOWING AUTOMOBILE LAUNDRIES OR CAR WASHES AS ADDITIONAL CONDITIONAL USES IN NEIGHBOR- HOOD COMMERCIAL (C-1) AND GENERAL COMMERCIAL (C-2) ZONES AND AMENDING SUBSECTION 21.29.050(1) TO ALLOW AUTOMOBILE LAUNDRIES OR CAR WASHES IN CONJUNCTION WITH SERVICE STATIONS AS ADDITIONAL CONDITIONAL USES IN THE COMMERCIAL TOURIST, (C-T) ZONE. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 21, Chapter 21.42 of the Carlsbad Municipal Code is amended by the deletion of Section 21.42.010(6)(A) which reads as follows: (6) Industrial Zones only: (A) Automobile laundries. SECTION 2: That Title 21, Chapter 21.26 of the Carlsbad Municipal Code is amended by the addition of Subsection 21.26.010(5) to read as follows: (5) Automobile laundries or car washes, subject to the following conditions: (A) The site shall be designed to reduce the visual imp,acts of buildings and waiting cars on surrounding development and from public streets. (B) All structures shall be architecturally designed to ensure compatibility with surrounding development. .. (C) A noise analysis addressing noise impacts on surrounding development may be required. ... The limits of this study shall be established by the Planning Director. (E) Adequate parking and circulation shall be provided onsite to accommodate .the proposed use. (F) Waiting areas for cars shall be screened by a combination of landscaping, fencing, and berming . I (G) ~ll signs shall comply with the approved sign program, or if none, the City's sign ordinance. , (H) Adequate means of eliminating grease and Oils from drainage systems shall be provided. In addition, automobile laundries and car washes may be permitted in conjunction with such automobile service stations and subject to the following conditions: (A) The site shall be designed to reduce the visual impacts of buildings and waiting cars on surrounding development and from public streets. (B) All structures shall be architecturally designed to ensure compatibility with surrounding development. 16 17 (c) A noise analysis addressing noise impacts on surrounding development may be required. 18 19 20 I (D) A traffic study which analyzes the impact of ~ the Proposed car wash on adjacent and nearby intersections may be required.
