HomeMy WebLinkAbout1988-03-02; Planning Commission; Resolution 2714z. ii 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 2714 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA RECOMMENDING APPROVAL OF THE ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.37, SECTION 21.37.100, OF THE CARLSBAD MUNICIPAL CODE, BY THE AMENDMENT OF SUBSECTION 21.37.100(7) TO ESTABLISH SETBACK STANDARDS FOR GARAGES, CARPORTS AND STORAGE CABINETS IN THE RMHP ZONE. APPLICANT: CITY OF CARLSBAD CASE NO.: ZCA 88-3 WHEREAS, the Planning Commission did, on the 2nd day of March 1988, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Code Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZCA 88-3, according to Exhibit tlAtt, dated March 2, 1988, attached hereto and made a part hereof, based on the follosing findings: Findinss : 1) This Zone Code Amendment is consistent with the General Plan's intent of preserving the public's health, safety, and welfare because it will establish setback standards necessary to maintain adequate fire safety. 2) This Zone Code Amendment is consistent with the General Plan's intent for residential zones which is to allow residential uses and adequate parking in a safe and consistent manner to serve these residents. 3) This Zone Code Amendment will not cause any significant adverse imapcts on the environment because a Negative Declaration was issued by the Planning Director on February 17, 1988 and recommended for approval by the Planning Commission on March 2, 1988. %* /I e 0 1 li 2 // PASSED, APPROVED AND ADOPTED at a regular meeting of the 3 I/ Planning Commission of the City of Carlsbad, California, held on 41( the 2nd day of March, 1988, by the following vote, to wit: 6 5 /I AYES : Chairperson McFadden, Commissioners: Hall, Schramm, Marcus, Schlehuber & Holmes. 7 8 9 NOES : None.
