PLANNING COMMISSION RESOLUTION NO. 2731
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A 28 , 300 SQUARE FOOT JOINT-USE SENIOR CENTER AND CARLSBAD UNIFIED SCHOOL DISTRICT ADMINISTRATIVE OFFICE ON
PROPERTY LOCATED AT 801 PINE AVENUE.
APPLICANT: CITY OF CARLSBAD CASE NO: CUP 88-4
WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a
request as provided by Title 21 of the Carlsbad Municipal Code;
and
WHEREAS, pursuant to the provisions of the Municipal
Code, the Planning Commission did, on the 18th day of May, 1988,
hold a duly noticed public hearing to consider said application
on property described as:
Lots 17 through 32 inclusive in Blocks 45 and
46; Lots 1 through 32 inclusive in Blocks 59 and
60, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 775 filed in the Office of the County Recorder of San Diego County, February
15, 1984.
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to CUP 88-4. NOW, THEREFORE, BE IT HEREBY RESOLVED by
the Planning Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission APPROVES CUP 88-4, based on the following findings and subject to the following conditions:

Findinqs:
1. That the proposed use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone for the reasons stated in the staff report.
2. The subject property is adequate in size and shape to
accommodate the proposed use for the reasons stated in the staff report.
3. All of the yards, setbacks, walls, fences, landscaping, and
other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained for the reasons stated in the staff report.
4. The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use for the reasons stated in the staff report.
5. The Planning Commission has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer
determines that sewer service is available, and building
cannot occur within the project unless sewer service remains
available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project.
6. All necessary public improvements have been provided or will be required as conditions of approval.
7. Assurances have been given that adequate sewer for the project will be provided by the City of Carlsbad.
8. This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Planning Director on April 22, 1988, and APPROVED by the Planning Commission on May 18, 1988. In approving this
. Negative Declaration the Planning Commission has considered the initial study, the staff analysis, all required mitigation measures and any written comments received regarding the significant effects this project could have on the environment.

Conditions:
1. Approval is granted for CUP 88-4, as shown on Exhibits I'A1'
on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions.

This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map.
3. Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and
the Costa Real Water District, dated May 25, 1983.
4. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building
permit issuance.
5. This Conditional Use Permit is granted for a period of ten
years. This Conditional Use Permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a significant detrimental impact on surrounding properties or the public health and welfare. If the Planning Director determines that the use has such significant adverse impacts, the Planning Director shall recommend that the Planning Commission, after providing the permittee the opportunity to be heard, add additional conditions to mitigate the significant adverse impacts. This permit may be revoked at any time after a public hearing, if it is found that the use has a significant
detrimental affect on surrounding land uses and the public's health and welfare, or the conditions imposed herein have not been met. This permit may be extended for a reasonable period of time not to exceed five years upon written application of the permittee made no less than 90
. days prior to the expiration date. In granting such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses or the public's health and welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surrounding land uses or the public's health and welfare is found, the extension shall be considered as an original application for a Conditional Use Permit. There is no limit to the number of extensions the Planning Commission may grant.

6. Trash receptacle areas shall be enclosed by a six-foot high
masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the
Planning Director. Enclosure shall be of similar colors
and/or materials to the project to the satisfaction of the Planning Director.
7. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the
satisfaction of the Directors of Planning and Building.
8. All Carlsbad Unified School District parking spaces located
within the Senior Center parking lot shall be clearly
labeled for such parking use.
9. An exterior lighting plan including parking areas shall be
submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property.
10. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director.
11. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first.
12. All parking lot trees shall be a minimum of 15 gallons in
size.
13. A master plan of the existing onsite trees shall be
provided to the Planning Director as part of the final grading plan to determine which trees shall be required to be preserved prior to the issuance of a grading permit or a
building permit, whichever occurs first.
14. All landscaped areas shall be maintained in a healthy and
thriving condition, free from weeds, trash, and debris.
15. Existing onsite trees shall be retained wherever possible
and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Department during the review of a Master Plan to submitted showing existing onsite trees Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Department.

16. The special education modular unit shown on the plans shall be moved on to other school district property. The area vacated by the modular shall be paved and striped for
parking to the satisfaction of the Planning Director.
17. A solid wall or fence shall be installed along the west end of the property to the satisfaction of the Planning Director .
18. This project is approved subject to the condition that the
existing pine trees fronting the property along Pine Avenue be preserved.
19. Any signs proposed for this development shall at a minimum
be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs.
20. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color.
21. Prior to issuance of a grading or building permit, whichever comes first, a soils report shall be prepared and submitted to the City of Carlsbad. If the soils report indicates the presence of potential fossil bearing material then a standard two phased program, on file in the Planning Department, shall be undertaken to avoid possible significant impacts on paleontological resources under the direction of the Planning Department.
2 2. This project is approved subject to the condition that all
above ground utilities existing onsite and fronting Pine
Avenue and Harding Street be undergrounded prior to
occupancy. Any proposed utilities shall also be
undergrounded.
23. The salmon color as proposed shall be reevaluated for
compatibility with the neighborhood. The City council
shall determine the final building color.
Ensineerinq Conditions:
24. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that
sewer facilities are available at the time of application for such sewer permits and will continue to be available
until time of occupancy.
25. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site.

26. The grading for this project is defined as Ilregular grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any required erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code.
27. Prior to hauling dirt or construction materials to any
proposed construction site within this project the developer shall submit to and receive approval from the
City Engineer for the proposed haul route. The developer
shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation.
28. Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer.
29. The 20 foot wide alley between the school district parking
lot and the new building.shal1 be vacated prior to issuance of building permits. Any utilities therein may need relocation or abandonment concurrent with construction activities.
30. Prior to issuance of building permits, a drainage plan for
this project and its effect on downstream properties shall
be prepared. Appropriate drainage structures shall, be incorporated into this plan to comply with current city standards.
31. The applicant shall be responsible -for the replacement of
curb, gutter, and sidewalk along the frontage of this
project that is found to be defective during the course of
construction.
32. Unless a standard variance has been issued, no variance
from City Standards is authorized by virtue of approval of this site plan.
33. The developer shall install a wheelchair ramp at the public street corner abutting the project in conformance with City
' of Carlsbad Standards prior to occupancy of any buildings.
Fire Conditions:
34. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the
Fire Department.
35. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal.

36. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval.
37. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site.
38. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent
to the project shall be submitted to the Fire Department for approval prior to construction.
39. Building exceeding 10,000 sq. ft. aggregate floor area
shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000
sq. ft. (or less) areas.
40. All hydrants and automatic sprinkler system appurtenances
shall be located to be free of obstruction by parking and
landscaping.
Parks and Recreation Conditions:
41. Prior to the issuance of building permits, detailed landscape and irrigation plans shall be presented for
approval to the Parks and Recreation Department. These plans shall incorporate:
a. Deep watering devices at each 15 gallon or larger tree,
three devices for each 24 inch box, four devices for each 36 inch box: deep watering device to be four inches high density polyethylene perforated drain pipe a minimum four inches in length, back filled with gravel.
b. Any tree planted within five feet of sidewalk or curb
shall be planted with root control barrier as per manufacturer specifications.
c. Landscape plant material requested to be changed as
noted on plans.
Costal Real Water District Conditions:
42. Prior to the issuance of building permits, the entire water
system for the project shall be evaluated in detail to
ensure that adequate capacity for domestic landscaping and
fire flow exists.
43. The Developer's Engineer shall schedule a meeting with the
Water District Engineer and the City of Carlsbad's Fire Marshall to review the preliminary water system layout
prior to preparation of the water system improvement plans.
