APPLICANT: REISER-OWN CASE NO.: V 88-1 WHEREAS, a verified application for certain property, to wit: Southwesterly half of Tract No. 217 of THUM Lands, City of Carlsbad, County of San Diego, according to Map thereof No. 1681. 11 has been filed with the City of Carlsbad, and referred to the 12 Planning Commission; and 13 14 15 WHEREAS, the Planning Commission did, on the 18th day of 16 May, 1988, hold a duly noticed public hearing as prescribed by 17 law to consider said request; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and l8 /I WHEREASr at said public hearing, upon hearing and 19 I considering all testimony and arguments, if any, of all persons 20 desiring to be heard, said Commission considered all factors 21 relating to v 88-1. 22 1( NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 23 II Commission of the City of Carlsbad as follows: 24 25 A) That the above recitations are true and correct. //// 27 findings and subject to the following conditions: 26 B, That based on the evidence presented at the public hearing, the Commission DENIES V 88-1, based on the following 28 //// I I 0 0 11 Findinss : 2 3 4 5 6 7 8 9 10 11 1. There are no exceptional or extraordinary circumstances that apply to this property and do not apply to others in the same vicinity. 2. The project is located in the Beach Area Overlay Zone and must comply with the same parking requirements as other pro j ects. 3. This property owner is not being denied a right enjoyed by other property owners because this and other lots in the area, similar in size, may be developed with two Units if guest parking is located outside the frontyard setback. 3. The proposed project may be detrimental to the General Plan because implementing ordinance requirements are not being met. PASSED, APPROVED, AND ADOPTED at a regular meeting of 12 13 14 15 16 17 18 19 20 21 the Planning Commission of the City of Carlsbad, California, held on the 18th day of May, 1988, by the following vote, to wit: AYES: Chairperson McFadden, Commissioners: Hall, Holmes, Marcus, Schlehuber and Schramm.
