PLANNING COMMISSION RESOLUTION NO. 2741 I
I
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A LARGE FAMILY
DAYCARE CENTER ON PROPERTY GENERALLY LOCATED AT 7654 GALLEON WAY.
APPLICANT: FRAZAR
CASE NO.: DC 88-1
WHEREAS, a verified application for certain property to wit: I
Lot 636 of La Costa South Unit No. 7 in the City of
Carlsbad, County of San Diego, State of California,
according to Map 6612 recorded in the Office of the
County Recorder on January 11, 1972,
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 21st day of
September, 1988, hold a duly noticed public hearing as prescribed
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to DC 88-1.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
Commission recommends APPROVAL of DC 88-1, based on the
following findings and subject to the following conditions:

Findinqs :
1. Immediate elimination of the daycare facility, because it causes the residential structure to not be in conformance with applicable planning, zoning and building standards, causes a hardship for the daycare clients.
2. Permitting the daycare facility to operate on a short term,
temporary basis provided certain zoning and building
nonconformities are rectified will allow the applicant time
to find other facilities which conform to planning, zoning
-and building requirements as well as allow time for the
daycare clients to seek other alternatives.
Conditions
1. The proposed daycare facility shall be moved into the family

the facility meets all of the required conditions.

PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 21st day of September, 1988, by the following vote, to wit:
AYES : Chairperson McFadden, Commissioners: Hall,
Schramm, Schlehuber, Marcus, Erwin and Holmes.
NOES : None.
ABSENT : None.
ABSTAIN: None.
