A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING WITHOUT PREJUDICE SITE DEVELOPMENT PLAN NO.

WHEREAS, a verified appl ication has been filed with the City of Carl sbad I
and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning

WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said

Commission considered all factors relating to SDP 88-5. NOW, THEREFORE, BE IT
HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commission DENIES without prejudice SDP 88-5, based on the following findings:
Findinqs:
1. The proposed project violates the intent of the height standard of the Beach Area Over1 ay Zone because it would permit a higher intensity of development than intended within the Beach Area as discussed in the Staff Report.

2. The overall project site and architectural design is not consistent with the design goals of the Beach Area Overlay Zone in that the structures
(1) are rather stark and massive, (2) provide no setback at the second story, and (3) include a dominance of hardscape within the frontyard setback and a dominance of garage doors along the street side elevations as discussed in the Staff Report.
