HomeMy WebLinkAbout1988-12-07; Planning Commission; Resolution 2772rt e 0 1 2 3 4 5 6 7 8 PLANNING COMMISSION RESOLUTION NO. 2772 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A REQUEST FOR A HILLSIDE DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED BETWEEN ELM AVENUE AND HOSP WAY AT THE EXISTING TERMINUS OF WINTERGREEN DRIVE. APPLICANT: VISTA DE LA VALLE CASE NO.: HDP 88-3 WHEREAS, a verified application for certain property to wit: Lot 1 through 8 inclusive and Lots 11 through 14 inclusive of CT 84-33 in the County of San Diego, State of California, according to Map thereof No. 11973, filed in the Office of the County Recorder of San Diego, 9 has been filed with the City of Carl sbad and referred to the P1 anning 10 Commi ssi on; and 11 WHEREAS, said verified application constitutes a request as provided 12 13 by Title 21 of the Carlsbad Municipal Code; and B) That based on the evidence presented at the public hearing, the Commission 21 A) That the foregoing recitations are true and correct. 20 fol 1 ows : 19 NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anning Commission as 18 considered all factors relating to the Planning Commission Determination; and 17 and arguments, if any, of all persons desiring to be heard, said Commission 16 WHEREAS, at said hearing, upon hearing and considering all testimony 15 consider said request; and 14 WHEREAS, the Planning Commission did on the 7th day of December, 1988, APPROVES HDP 88-3, based on the following findings and subject to the 22 following conditions: 23 1. Undevelopable areas of the project have been properly identified. 25 approvals and permits are consistent with the purpose, intent, and 27 requirements of this chapter. 28 5 II 0 0 4. The project design and lot configuration minimizes disturbance of 1 5. The project design substantially conforms to the intent of the concepts 2 hillside lands. illustrated in the hillside development guidelines manual. 3 6. The project as proposed includes; (1) the creation of a cut slope in 4 excess of 30 feet along the south side of Doreet Way and, (2) grading that the project will have a significant effect on the environment. 5 of some small isolated ravines where there is no substantial evidence because; (1) the cut slope in excess of 30 feet is temporary in nature consistent with the intent and provisions sf the Hillside Ordinance 6 As discussed in the Staff Report, this proposed grading is however with Section 21.95.090(4) of the Hillside Ordinance isolated pockets provisions and requirements of the Hillside Ordinance. 7 of environmentally insignificant steep slopes are excluded from the 8 and is not visible from outside of the project, and (2) in accordance 9 10 1. The grading as proposed, shall occur substantially as shown on Exhibit 11 PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning 12 "Q", dated November 30, 1988.
