APPLICANT: CITY OF CARLSBAD CASE NO: CUP 88-13 WHEREAS, a verified application has been filed with the City and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, 1 Commission did, on the 15th day of February, 1989, hold a duly no1 hearing to consider said application on property described as: Portion of tracts 248 and 249, Thum Lands, Map No. 1681 WHEREAS, at said pub1 ic hearing, upon hearing and cons. testimony and arguments, if any, of all persons desiring to be Commission considered all factors relating to CUP 88-13. NOW, TH IT HEREBY RESOLVED by the Planning Commission of the City of fol 1 ows : A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public he Commission APPROVES CUP 88-13, based on the following f. subject to the following conditions: Findinqs: 1. That the proposed use is necessary and desirable for the dev the community, is essentially in harmony with the various e objectives of the general plan, and is not detrimental to ex or to uses specifically permitted in the zone in which the p is to be located, for reasons stated in the staff report. 2. All of the yards, setbacks? walls, fences, landscaping, features necessary to adjust the requested use to existing or future uses in the neighborhood will be provided and maintain 4. This project is categorically exempt from environmental revig to section 15301(l)(a) of the California Environmental Qualil Conditions: 1. Approval is granted for CUP 88-13, as shown on Exhibit (s) dated December 14, 1988, incorporated by reference and on f P1 anning Department. Development shall occur substanti a1 1, unless otherwise noted in these conditions. 2.
