CALIFORNIA, RECOMMENDING APPROVAL OF A TENTATIVE TRACT MA PROPERTY GENERALLY LOCATED APPROXIMATELY 1000' NORTHWEST OF CORNER OF ALGA ROAD AND EL CAMINO REAL. APPLICANT: VIEWPOINT CASE NO.: CT 85-34 WHEREAS, a verified application for certain property to wit: Southeast Quarter of the Northwest Quarter of Section 26, Towr 12 South, Range 4 West, San Bernadino Meridian, County of Di ego. has been filed with the City of Carl sbad and referred to th Commission; and WHEREAS, said verified application constitutes a request as 1 Title 21 of the Carl sbad Municipal Code; and WHEREAS, the Planning Commission did, on the 19th day of Ar hold a duly noticed pub1 ic hearing as prescribed by 7 aw to con request; and WHEREAS, at said public hearing, upon hearing and consil testimony and arguments, if any, of all persons desiring to be h Commission considered all factors relating to the Tentative Tract I NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anni ng Con fol 1 ows : A) That the above recitations are true and correct. B) That based on the evidence presented at the public he Commission recommends APPROVAL of CT 85-34, based on the findings and subject to the following conditions: Findinqs: 1. The project is consistent with the City's General Plan since tl density of 3.1 dus/acre is within the density range of 0- specified for the site as indicated on the Land Use Elemi General Plan, and is at or below the growth control point of 0 * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. The site is physically suitable for the type and densil development since the site is adequate in size and shape to a residential development at the density proposed. 3. The project is consistent with all City public facility PO' ordinances since: a) The P1 anning Commission has, by incl usion of an approp condition to this project, ensured that the final map wil be approved unless the City Council finds that sewer se is available to serve the project. In addition, the Pla Commission has added a condition that a note shall be p on the final map that building permits may not be issuec the project unless the City Engineer determines that service is available, and building cannot occur withil project unless sewer service remains avai 1 ab1 e, and Planning Commission is satisfied that the requirements o Pub1 ic Facil i ties Element of the General P1 an have beel insofar as they apply to sewer service for this project- b) The Carl sbad School District has written a letter, dated April 7, 1988, stating that school facilities will be available to this project. c) Park-in-lieu fees are required as a condition of approva d) All necessary public improvements have been provided or be required as conditions of approval. e) The appl icant has agreed and is required by the incl usi I an appropriate condition to pay a public facilities Performance of that contract and payment of the fee will el this body to find that public facilities will be avai' concurrent with need as required by the General Plan. f) Assurances have been given that adequate sewer for the project will be provided by the City of Carl sbad. 4. The proposed project is compatible with the surrounding future since surrounding properties on three side are designated for r development on the General P1 an and buffered from commercial d to the east by an intervening steep slope. 5. This project will not cause any significant environmental imp Mitigated Negative Declaration has been issued by the Plannin! on January 6, 1989 and recommended for approval by the Commission on April 19, 1989. In approving this Negative Decla Planning Commission has considered the initial study, the staff all required mitigation measures and any written comments regarding the significant effects this project could hav environment. This project is consistent with the City's Growth Management as it has been conditioned to comply with any requirement a part of the Local Facilities Management Plan for Zone 6. 8. This project was subject to Chapter 21.95 of the Carlsbad Muni (Hillside Ordinance) and meets all the requirements of that 1 ensure the sensitive treatment of the City's hillside resourc Conditions: 1. The developer shall provide the City with a reproducible 24" scale my1 ar copy of the Tentative Map as approved by thc Commission. The Tentative Map shall reflect the conditions 0: by the City. Prior to any grading at the project site, a paleontol shall be retained to perform a walkover survey of the sit to review the grading plans to determine if the pro grading will impact portions of the Santiago Formation. A qualified paleontologist shall be retained by the appl to perform periodic inspections of the site and to sa exposed fossils. Repair or reconstruction of the Ayers sewer trunkline shall be prior to occupancy of any portion of thi s project unl c demonstrated to the satisfaction of the City Engineer and th Director that: a. Adequate capacity is available to accommodate the sewage this project, and b. An agreement and appropriate security (bond) is accepted I of Carlsbad. The agreement shall guarantee the proportic of this project (by equivalent dwelling unit) for the reconstruction of the Ayers sewer main, pump station or f including but not limited to; manholes, laterals, 1 facilities, pump station and force mains. 41. The developer shall submit approval by the Cal ifornia Sta Commission prior to final map approval. 42. Approval of this tentative tract map shall expire twenty-four ( from the date of City Counci 1 approval unless a final map is An extension may be requested by the applicant. The developer shall exercise special care during the construc of this project to prevent any offsite siltation. The basins and erosion control measure: shown and specified on the grading plan and shall be construc satisfaction of the City Engineer prior to the start of any 0th operations. Prior to the removal of any basins or faci constructed the area served shall be protected by additiona facilities, slope erosion control measures and other methods r approved by the City Engineer. The developer shall mai temporary basins and erosion control measures for a perio satisfactory to the City Engineer and shall guarantee their m and satisfactory performance through cash deposit and bonding and types suitable to the City Engineer. Additional drainage easements and drainage structures shall b or installed as may be required by the City Engineer. 18 53. Prior to approval of the final map the devel oper shall pay or an agreement with the City to pay for a proportional sha 19 drainage area fees established as a result of the forthcom I Drainage P1 an Update. 20 21 22 23 24 54. The developer shall construct desiltation/detention basins of size and at locations as approved by the City Engineer. The shall enter into a desiltation basin maintenance agreement ar maintenance bond satisfactory to the City Engineer prior to tt of grading, building permit or final map whichever occurs fir: project. Each desiltation basin shall be serviced by an 2 access/maintenance road. Prior to final ma the developer shall bond for the removal of the basin and the of the public drainage pipe to the southwest of the SDG&E easen road. Extension of the drainage pipe shall be completed direction of the City Engineer when the upstream basin stabilized against erosion. ~ 56. The owner of the subject property shall execute a hold harmless regarding drainage across the adjacent property prior to the a the final map for this project. 57. Drainage from this project enters into two existing desiltat identified as DG 17 and DG 27 on the Drainage Master Plan for Prior to approval of the final map the developer shall en1 secured drainage basin maintenance agreement with the City t a pro-rata share of the basin against siltation occurring project. The agreement shall remain in effect until such t City Engineer determines that the project site has been stabilized against erosion. The Tentative Map as proposed includes a Minor Diversion of Drainage Water to the Drainage course located southwest of the project development. Prior to approval of the Final Map, the developer shall obtain the approval of the downstream property owner or shall redesign the drainage system so as not to divert drainage or increase drainage runoff beyond pre-redevel opment conditions to the satisfaction of the City Engineer. 15 16 pub1 ic streets and easements required by these conditions or SI tentative map.
