GARAGES ON PROPERTY GENERALLY LOCATED EAST OF HARDING STREET BETWEEN PINE AVENUE AND CHESTNUT AVENUE. APPLICANT: CHARTWOOD SDP 88-15 TO ALLOW THE CONSTRUCTION OF SEVEN TWO-CAR CASE NO: SDP 88-15 WHEREAS, a verified appl ication has been filed with thl Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request a by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Planning Commission did, on the 19th day of April, 1989, consider sa on property described as: Parcel 1 of Parcel Map 2893 in the City of Carlsbad, County of San Diego, as recorded on July 31, 1974. WHEREAS, at said public hearing, upon hearing and consi testimony and arguments, if any, of all persons desiring to be h Commission considered all factors relating to SDP 88-15. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Cor the City of Carl sbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the APPROVES SDP 88-15, based on the following findings and sub: following conditions: 22 23 24 25 26 27 Fi ndi nqs : 1. The use is currently a legal nonconforming use due to the exisl situation. The project will not increase the degree of noncc 3. Approval of this request shall not excuse compl iance with a1 1 I the Zoning Ordinance and a1 1 other appl icabl e City Ordinance2 at time of building permit issuance. 3. This project is a1 so approved under the express condi tior July 28, 1987 and as amended from time to time, and any develc established by the City Council pursuant to Chapter 21.90 of tt Municipal Code or other ordinance adopted to implement a growth system or facilities and improvement plan and to fulfill the SL agreement to pay the publ ic facilities fee dated October 31, 19; agreement to pay the Growth Management Fee dated October 31, 1: of which are on file with the City C1 erk and are incorporat reference. All fire alarm systems, fire hydrants, extinguishing systems, sprinklers, and other systems pertinent to the project shall bc to the Fire Department for approval prior to construction. 13.
