CALIFORNIA, FINDING THAT THE PROPOSED EXTENSION OF POINSETTIA BETWEEN BATIQUITOS DRIVE AND THE APPROVED INTERSECTIOb POINSETTIA LANE AND ALGA ROAD IS CONSISTENT WITH THE GENERAL I APPLICANT: HILLMAN PROPERTIES CASE NO.: PCD/GPC 89-1 WHEREAS, a verified application for certain property to wit: That certain parcel of 1 and del ineated and designated "Description No. 1,103.91 acres" on record of Survey Map No. E being a portion of Lot "G" of Rancho Agua Hedionda, Map No. in the City of Carlsbad, County of San Diego, State of Califor has been filed with the City of Carl sbad and referred to thl Commission; and WHEREAS, said verified application constitutes a request as r Title 21 of the Carlsbad Municipal Code; and WHEREAS, the P1 anning Commission did on the 3rd day of I consider said request; and WHEREAS, at said hearing, upon hearing and considering all te! arguments, if any, of all persons desiring to be heard, said considered all factors relating to the Planning Commission Determir NOW, THEREFORE, BE I1 HEREBY RESOLYEB by the P1 anni ng Comr fol1 ows : A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the pub1 ic he; Commission APPROVES PCDIGPC 89-1, based on the following fi subject to the following conditions: Findinqs: 1. The proposed extension of Poinsettia Lane between Batiquitos the approved intersection of Poinsettia Lane and Alga Road is with the goals and objectives of the Gener-a1 Plan in that, a. VehicScs and pedestrians will be able to travel in a safe more efficient manner; b. This segment of Poinsettia Lane will conform to the Design Standards for major arterials, e. This street extension will provide adequate street safe f. Adequate sidewalks and median and roadside landscaping w incorporated into the road design, 2. This roadway extension is consistent with the Mello I1 Loc Program, and the Zone 19 Local Facilities Management Plan. 3. This project will not cause any significant environmental im Conditional Negative Declaration has been issued by the Planni on March 10, 1989 and approved by the Planning Commission Ma Conditions: 1. This project is approved subject to the condition that all m slopes are fully landscaped and maintained by the project (Hi1 lman Properties). Prior to the issuance of a grading per1 1 andscape and irrigation plan shall be submitted for review a1 to the P1 anning Director. Those plant types used along mi slopes shall be selected so as not to cause any adverse adjacent agricultural uses. 2. Prior to the issuance of a grading permit, the project develop Properties) shall be required to pay agricultural mitigation f acres of agricultural land. This fee total and structur, determined by the City of Carlsbad, consistent with the F Country C1 ub and Resort Master Plan (MP-177). 3. This project is approved, subject to compliance with the folloi a) Grading shall comply with the City of Carl sbad grading and b) Grading activity shall be prohibited during the rainy st October 1st to April 1st of each year; and c) A1 1 graded areas shall be 1 andscaped prior to October 1 year with either temporary or permanent landscaping m; reduce erosion potential. Such 1 andscaping shall be mail replanted if not well -estab1 ished by December 1st fol initial planting. d) A1 1 permanent runoff-control and erosion-control device developed and installed prior to or concurrent with grading activities.
