APPLICANT: AVIARA PACIFIC LOCATED TO THE NORTH OF BATIQUITOS LAGOON, BETWEEN 1-5 CASE NO: MP-l77(A) WHEREAS, a verified appl ication for certain property, tc Portions of Sections 22, 26, 27, 28, 33, 24 and 35 in 7 Carlsbad, County of San Diego, State of California, WHEREAS, a verified appl ication constitutes a request a south, Range 4 West, San Bernardino Meridian in th by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 17th day of and the 7th day of June, 1989, hold duly noticed public hearings as by law, to consider said request; and WHEREAS, the Planning Commission did consider thc Departments review of the said request dated May 17, 1989 and which specific modifications to the said request; and WHEREAS, at said publ ic hearing, upon hearing and cons. testimony and arguments, if any, of all persons desiring to be t Commission considered all factors relating to the Master Plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Co f 01 1 ows : A) That the foregoing recitations are true and corre B) That based on the evidence presented at the publ the Commission recommends APPROVAL of MP-l77(A), Exhibit IlB" dated May 17, 1989, as revised May 9 which incorporates staff suggested modifications t following findings and subject to the following c Findinqs: 1.
