APPLICANT: HILLSIDE PARTNERS CASE NO.: CT 88-5 WHEREAS, a verified application for certain property to Lots 16 and 17 in Block G of Bellavista in the City of according to Map thereof No. 2152 filed in the office of the County Recorder March 7, 1929. A1 so, that portion of Lot 18 and said Block G of Bellavista lying northerly of the easterly prolongation of the northerly line of the southerly 5 feet of Lot 1 in Block E of Bellavista. Carlsbad, County of San Diego, State of California has been filed with the City of Carl sbad and referred to tt Commission; and WHEREAS, said verified application constitutes a request by Title 21 of the Carl sbad Municipal Code; and WHEREAS, the Planning Commission did, on the 7th day of hold a duly noticed pub1 ic hearing as prescribed by law to COI request; and WHEREAS, at said public hearing, upon hearing and cons testimony and arguments, if any, of all persons desiring to be Commission considered all factors relating to the Tentative Tri P1 anned Unit Devel opment . The project is consistent with the City's General Plan since th proposes development of single family detached homes within th range of 0 to 4 dwell ing units per acre as specified on tht indicated by 1 and use on the General Plan. The project is propc developed above the Growth Control Point of 3.2 dwell ing unit acre for the site. This is justified given the significant improvements on site which will improve drainage facilities f along with aiding in maintaining the Agua Hedionda. There is ! developments within Zone 1 that have been developed below th Control Point to a1 1 ow this project to exceed by 2 duel 1 ings 1 Control Point intensity for the site. 2. With the correction of existing drainage and geotechnical situa site is physically suitable for the type and density of the d since the site is adequate in size and shape to accom residential development and the density proposed. 3. This project is consistent with the City’s Growth Management Or it has been conditioned to comply with any requirement approv of the Local Facilities Management Plan for Zone 1. 12. This project was subject to Chapter 21.95 of the Carlsbad Muni (Hillside Ordinance) and meets all the requirements of that ensure the sensitive treatment of the City’s hillside resource Conditions: 1. Approval is granted for CT 88-5/HDP 89-1, as shown on Exhibii dated June 7, 1989, incorporated by reference and on file in tl Department. Development shall occur substantially as sh otherwise noted in these conditions. 2. The developer shall provide the City with a reproducible 24” scale my1 ar copy of the Tentative Map as approved by th Commission. The Tentative Map shall reflect the conditions t by the City. The developer shall obtain a grading permit prior to the comm any clearing or grading of the site. 26. The grading for this project is defined as "controlled grading' 11.06.170(a) of the Carlsbad Municipal Code. Grading shall b under the observation of a civil engineer whose responsibili be to coordinate site inspection and testing to ensure compli work with the approved grading plan, submit required reports . Engineer and verify compl i ance with Chapter 11.06 of tt Muni ci pal Code. 27. Upon completion of grading, the developer shall ensure that an geologic plan shall be submitted to the City Engineer. A separate grading plan shall be submitted and approved and a grading permit issued for the borrow or disposal site if locat the city limits. 30. All slopes within this project shall be no steeper than 2:l. 31. Prior to hauling dirt or construction materials to any construction site within this project the developer shall sub1 receive approval from the City Engineer for the proposed haul r developer shall comply with all conditions and requirements Engineer may impose with regards to the hauling operation. 32. The developer shall exercise speci a1 care during the construc. of this project to prevent any offsite siltation. The developer shall maintain tht basins and erosion control measures for a period of time sati5 the City Engineer and shall guarantee their maintenance and si performance through cash deposit and bonding in amounts and typc to the City Engineer. 33. Additional drainage easements and drainage structures shall t or installed as may be required by the City Engineer. 34. The developer shall pay the current 1 oca1 drainage area fel approval of the final map for this project or shall construc systems in conformance with the Master Drainage Plan and City t Standards as required by the City Engineer. 35. The owner of the subject property shall execute a hold harmles! regarding drainage across the adjacent property prior to the final map for this project. 36. The developer shall make an offer of dedication to the City for streets and easements required by these conditions or shl Tentative Map. The offer shall be made by a certificate on th for this project. Plans, specifications, and supporting documents for all improve1 be prepared to the satisfaction of the City Engineer. Prior 1 of the final map, the Subdivider shall install, or agree to i secure with appropriate security as provided by law, improven on the tentative map and the following improvements to City Si the satisfaction of the City Engineer: a.
