APPLICANT: HOEHN CASE NO: CUP 89-4 WHEREAS, a verified application has been filed with t Carl sbad and referred to the Planning Commission: and WHEREAS, said veri f i ed appl i cat i on constitutes a request by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Planning Commission did, on the 5th day of July, 1989, hold a dl public hearing to consider said application on property described Lot 8 of Carlsbad Tract No. 87-3. WHEREAS, at said public hearing, upon hearing and cons testimony and arguments, if any, of all persons desiring to be ~ Commission considered all factors relating to CUP 89-4. B) That based on the evidence presented at the public hearing, the APPROVES CUP 89-4, based on the foll owing findings and sub, following conditions: Findinqs: 1. That all of the yards, setbacks, walls, fences, landscaping, features necessary to adjust the requested use to existing 01 future uses in the neighborhood will be provided and mainta project is proposed with landscaping, fencing and a front yi consistent with Specific Plan 19(C) standards. 4. That Car Country Drive as well as adjacent roadways are a properly hand1 e a1 1 traffic generated by the proposed use. 5. All necessary public improvements have been provided or will I as conditions of approval . 6. The appl i cant is by condition, required to pay any increase facility fee, or new construction tax, or development fees, and to abide by any additional requirements established by a Local Management Plan prepared pursuant to Chapter 21.90 of th Municipal Code. This will ensure continued availability facilities and will mitigate any cumulative impacts creal project . 7. This project is consistent with the City's Growth Management 0 it has been conditioned to comply with any requirement appro' of the Local Facilities Management Plan for Zone 3. 8.
