DENYING AN APPEAL OF A PLANNING DIRECT DETERMINATION CONCERNING BUILDING HEIGHT IN THE R-1 ZONE PROPERTY GENERALLY LOCATED AT 2987 HIGHLAND DRIVE, CARLS CALIFORNIA APPLICANT: GARY NESSIM CASE NO. : PCD 89-3 WHEREAS, a verified application for certain property at: 2987 Highland Drive, Carlsbad, California, has been filed with the City of Carl sbad and referred to thc Commission; and WHEREAS? said verified application constitutes a request as F Title 21 of the Carlsbad Municipal Code; and WHEREAS? the Planning Commission did on the 2nd day of Aug consider said request; and WHEREAS? at said hearing, upon hearing and considering all te: arguments? if any, of all persons desiring to be heard, said considered all factors relating to the Appeal of a Planning Determination; and NOW, THEREFORE? BE IT HEREBY RESOLVED by the P1 anning Con f 01 1 ows : A) That the foregoing recitations are true and correct, B) That based on the evidence presented at the public he Commission DENIES PCD 89-3, based on the following findings: Findinss: 1. Although the proposed structure could be interpreted to comply with the building height definition of 21.04.065, t height and number of stories violates the purpose and intent Residential Low-Medium Land Use Designation of the General F Zone by substantially grading the site and creating a 3 structure which is 30 to 39 feet in height. ..* ll e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. The building does not meet development guide1 ines adopted in Use Element of the General Plan indicating the need to prc neighborhood atmosphere of residential areas and to assure t proposed buildings in terms of size, height and location wit1 neighboring development. 3. The height as proposed does not meet Section 21.10.02 of tht requiring a maximum of 35 feet in height. 4. The height as proposed, is not compatible with surrounding 01 story single family homes. PASSED, APPROVED, AND ADOPTED at a regular meeting of thc Commission of the City of Carlsbad, California, held on the 2nd day 1989, by the following vote, to wit: AYES: Chairman Hall, Commissioners: Schramm, Erwin, McFa Holmes and Marcus.
