GENERALLY LOCATED WEST OF CAR COUNTRY DRIVE AND SOUTH OF CANNON ROAD. APPLICANT: PACIFIC JEEP/EAGLE SDP 89-10 FOR A JEEP/EAGLE AUTO DEALERSHIP ON PROPERTY CASE NO: SDP 89-10 WHEREAS, a verified application has been filed with the City Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provi by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, Planning Commission did, on the 2nd day of August, consider said request property described as: Lot 7 of Carlsbad Tract 87-03 being a subdivision of a portion of Lot H of Rancho Agua Hedionda in the City of Carlsbad, County of San Diego, State of California, according to Map No. 82-3 filed in the office of the County Recorder of said County November 16, 1896, APN 211-080-07. WHEREAS, at said public hearing, upon hearing and considering testimony and arguments, if any, of all persons desiring to be heard, 1 Commission considered all factors relating to SDP 89-10. NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anning Commission of City of Carl sbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commis APPROVES SDP 89-10, based on the following findings and subject to fol 1 owi ng condi t i ons : Findinqs: 1. This project shall comply with all conditions and mitigation required the Zone 3 Local Facilities Management Plan approved by the City Counc incorporated herein and on file in the Planning Department and any fut amendments to the Plan made prior to the issuance of building permits 7. If any condition for construction of any public improvements facilities, or the payment of any fees in lieu thereof, imposed by t approval or imposed by law on this project are challenged this apprc shall be suspended as provided in Government Code Section 65913.5. All roof appurtenances, including air conditioners, shall architecturally integrated and concealed from view and the sound buffe from adjacent properties and streets, pursuant to Building Departn Policy No. 80-6, to the satisfaction of the Directors of Planning Building. 11. Compact parking spaces shall be 1 ocated in 1 arge groups in 1 ocations the satisfaction of the Planning Director. 12. No outdoor storage of material shall occur onsi te unless required by Fire Chief. In such instance a storage plan will be submitted approval by the Fire Chief and the Planning Director. 13. Due to the intense use of the subject site, no other dealership shall permitted without approval by the Planning Commission. 14. An exterior lighting plan showing architectural style and lumens shal- submitted for Planning Director approval prior to building pel issuance. All lighting shall be in conformance with SP 19(C) K and SI be designed to reflect downward and avoid impacts on adjacent proper1 15. A test driving map shall be submitted for Planning Director approval pi to issuance of building permits. Prior to the issuance of any City Permits, the applicant shall subm copy of a valid Coastal Development Permit allowing construction of project which is in substantial conformance with this approval- 17. All employee, customer, and service parking as shown on the site shall be clearly demarcated by signs and shall be kept free of displa inventory parking. 18. The applicant shall provide tables and benches within the outdoor 1 areas. The lunch area shall be constructed concurrently with the prop buildings and completed prior to occupancy. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 24. The grading for this project is defined as "regular grading" by Sect 11.06.170(a) of the Carlsbad Municipal Code. The developer shall sub1 a grading plan for approval which shall include a1 1 required drain< structures and any required erosion control measures. The developer sh, a1 so submit soils, geologic or compaction reports if required and shi comply with all provisions of Chapter 11.06 of the Carlsbad Municil Code. 25. No grading shall occur outside the limits of the project unless a let. of permission is obtained from the owners of the affected properties. 26. A separate grading plan shall be submi tted and approved and a separ grading permit issued for the borrow or disposal site if located wit the city limits. 27.
