PLANNING COMMISSION RESOLUTION NO. 2910
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A DISCUSSION ITEM
DETERMINING SUBSTANTIAL CONFORMANCE OF PLANS SUBMITTED
FOR THE DEVELOPMENT OF 130 CONDOMINIUM UNITS GENERALLY LOCATED AT THE TERMINUS OF HARBOR DRIVE EAST OF THE AT&SF RAILROAD.
APPLICANT: MARLBOROUGH DEVELOPMENT
CASE NO.: DI 89-4
WHEREAS, a request has been submitted to the City of Car
referred to the Planning Commission; and
WHEREAS, the Planning Commission did, on the 6th day of :
1989, discuss the request on property described as CT 83-4/CP-227; ai
WHEREAS, upon considering the request, said commission 1
all factors relating to the substantial conformance determination.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con
fol 1 ows :
A) That the above recitations are true and correct.
B) That based on the evidence provided by staff, the Commission AI determination of substantial conformance, based on the followin(
Findinqs:
1. An EIR was completed on the site and resulting mitigations as 1 City Council Resolution No. 7384 will not be altered and will (
be effective.
2. The proposed modifications are consistent with the provisions of Carlsbad Zoning Ordinance.
1 3. The modified plan brings it into conformance with Califori i Commission requirements.
4. The modified plan is consistent with the general intent and c the original approval.
