CALIFORNIA, DENYING A CONDITIONAL USE PERMIT FOR A SELF SERVIC WASH ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER 01 PIC0 DRIVE AND ELM AVENUE. APPLICANT: SHELL CAR WASH CASE NO: CUP 88-12 WHEREAS, a verified appl ication has been filed with the City ( and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as I Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, tt Commission did, on the 6th day of September, 1989, and the 2( September, 1989, hold a duly noticed public hearing to con: appl ication on property described as: Portion of Tract 115 of the Town of Carlsbad, according to May filed February 15, 1894 WHEREAS, at said public hearing, upon hearing and consic testimony and arguments, if any, of all persons desiring to be h Commission considered all factors relating to CUP 88-12. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commiss City of Carl sbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public he; Commission DENIES CUP 88-12, based on the following findings: Findings: 1.
