CASE NAME: PALOMAR POINTE NO. SDP 89-12 TO DEVELOP A 13.92 ACRE PLANNED INDUSTRIAL CASE NO: SDP 89-12 WHEREAS, a verified appl ication has been filed with thc 6 7 8 9 10 11 12 The portion of Lot 'IF" of the Rancho Agua Hedi onda, in 13 the City of Carl sbad, according to map t.hereof No. 823, filed November 16, 1896. 14 WHEREAS, at said public hearing, upon hearing and consic 15 testimony and arguments, if any, of all persons desiring to be hc 16 Commission considered all factors relating to SDP 89-12. 17 18 19 Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request a: by Title 21 of the Carl sbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Planning Commission did, on the 6th day of December, 1989, consider sa on property described as: NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Com the City of Carlsbad as follows: 1 A) That the foregoing recitations are true and correct. 20 21 22 23 24 25 26 27 B) That based on the evidence presented at the pub1 ic hearing, the APPROVES SDP 89-12, based on the following findings and subj following conditions: Findinqs: 1. School fees will be paid to ensure the avail abil ity of school i in the Carl sbad School District. 3. Park-in-lieu fees are required as a condition of approval. 4. All necessary public improvements have been provided or will bl as conditions of approval. 5. The appl icant has agreed and is required by the incl usi appropriate condition to pay a public facilities fee. Performan contract and payment of the fee will enable this body to find t facil ities will be available concurrent with need as requir General P1 an. 6. The proposed project is compatible with the surrounding future since surrounding properties are designated for Planned devel opment on the General P1 an. 7. This project will not cause any significant environmental imp; Conditional Negative Decl arat i on has been issued by the P1 anni n on October 20, 1989 and approved by the Planning Commission 01 6, 1989. In approving this Negative Declaration the Planning i has considered the initial study, the staff analysis, all mitigation measures and any written comments received rega significant effects this project could have on the environment 8. The appl icant is by condition, required to pay any increase facility fee, or new construction tax, or development fees, and to abide by any additional requirements established by a Local Management Plan prepared pursuant to Chapter 21.90 of the Municipal Code. This will ensure continued availability facilities and will mitigate any cumulative impacts creatc project. 9. This project is consistent with the City's Growth Management Or it has been conditioned to comply with any requirement approvl of the Local Facilities Management Plan for Zone 5. 10. This project was subject to Chapter 21.95 of the Carlsbad Muni (Hillside Ordinance) and meets all the requirements of that 1 ensure the sensitive treatment of the City's hillside resource 11. The project complies with the development standards and design of the P-M zone. 12. The project, as conditioned, is compatible with "Palomar Airpo 13. Approval is granted for SDP 89-12, as shown on Exhibit (s) "A" - November 16, 1989, incorporated by reference and on file in the Department. Development shall occur substanti a1 ly as shob otherwise noted in these conditions. 2. The developer shall provide the City with a reproducible 24" x 2 copy of the site plan as approved by the P1 anning Commission. plan shall reflect the conditions of approval by the City, Cal i fornia Coastal Commission. The plan copy shall be submi tt City Engineer prior to issuance of building permits or improve submittal , whichever occurs first. 8 3. This project is a1 so approved under the express condition applicant pay the public facilities fee adopted by the City 1 July 28, 1987 and as amended from time to time, and any develo established by the City Council pursuant to Chapter 21.90 of th Municipal Code or other ordinance adopted to imp1 ement a growth system or facilities and improvement plan and to fulfill the su agreement to pay the public facilities fee dated August 1, 19: of which is on file with the City Clerk and is incorporate reference. If the fees are not paid this application wi consistent with the General Plan and approval for this projec void. 6. The applicant shall pay park-in-lieu fees to the City, pri approval of the final parcel map (MS-824) as required by Chaptp the Carlsbad Municipal Code. 7. 8. ....
