CASE NAME: AVIARA CALIFORNIA, APPROVING THE SITE PLANNING INFORMATION FOR A CASE NO.: DI 89-7 FOR PUD-104 WHEREAS, a verified application for certain property to wit: Portions of Sections 26, 27 and 34 in Township 12 south, Rang west, San Bernardino Meridian, in the City of Carlsbad, County San Diego, State of California. has been filed with the City of Carl sbad and referred to the Commission; and WHEREAS, said verified application constitutes a request as pu Title 21 of the Carlsbad Municipal Code: and WHEREAS, the Planning Commission did, on the 21st day of Febru; consider said request; and WHEREAS, at said hearing, upon hearing and considering all tes arguments, if any, of all persons desiring to be heard, said considered all factors relating to the Discussion Item; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anning Coml fol 1 ows : A) That the above recitations are true and correct. B) That based on the evidence presented at the hearing, the APPROVES DI 89-7, based on the following findings and subjl following conditions: Findincls: 1. The project is consistent with the City’s General Plan since tl density of 2.38 du’s/acre is within the density range of 0-4 specified for the site as indicated on the Land Use Elemc General P1 an, and is at or below the growth control point of 2. The site is physically suitable for the type and densi development since the site is adequate in size and shape to i residential development at the density proposed. The Planning Commission has, by inclusion of an appropriate con this project, ensured building permits will not be issued for th unless the City Engineer determines that sewer service is avail building cannot occur within the project unless sewer servic available, and the Planning Commission is satisfied that the req of the Pub1 ic Facil ities Element of the General Plan have insofar as they apply to sewer service for this project. 4. The dedication of the 12.4 acre school site at the intersectic Road and Ambrosia Lane is acceptable as mitigation of the existing Carlsbad Unified School District school facilities. 5. The dedication of a 24.25 acre park site at the northern te Ambrosia Lane satisfies park fee requirements. 6. All necessary pub1 ic improvements have been provided or will bt as conditions of approval. 7. The appl icant has agreed and is required by the i ncl usi appropriate condition to pay a public facilities fee. Perfc that contract and payment of the fee will enable this body to public facilities will be available concurrent with need as rf the General P1 an. 8. Assurances have been given that adequate sewer for the projec provided by the City of Carlsbad. 9. As conditioned, the project is consistent with: (1) the dl standards and design guide1 ines of Master Plan 177 and tt Development Ordinance and the "Architectural Guide1 ines For Single Family Detached Units." 10. The proposed project is compatible with the surrounding future since surrounding properties are designated for residential d on the General P1 an. 11. The applicant is by condition, required to pay any increase facil ity fee, or new construction tax, or development fees agreed to abide by any additional requirements established I Facil i ties Management P1 an prepared pursuant to Chapter 21, Carl sbad Municipal Code. This will ensure continued avail' public facilities and will mitigate any cumulative impacts crei project. 12. This project is consistent with the City's Growth Management as it had been conditioned to comply with any requirement a part of the Local Facilities Management Plan for Zone 19. 13. A protective fence or wall shall be placed at the top of the retaining wall, to the satisfaction of the City Engineer, on having a retaining wall higher than two feet. 11.
