CASE NAME: AVIARA CALIFORNIA, APPROVING THE SITE PLANNING INFORMATION FOR A CASE NO.: DI 89-7 FOR PUD-105 5 11 WHEREAS, a verified application for certain property to wit: 6 7 Portions of Sections 26, 27 and 34 in Township 12 south, Ran5 west, San Bernardino Meridian, in the City of Carlsbad, CountJ San Diego, State of California. 8 9 has been filed with the City of Carl sbad and referred to the Commission; and lo /I WHEREAS, said verified application constitutes a request as p 11// Title 21 of the Carlsbad Municipal Code; and I.2 /I WHEREAS, the Planning Commission did, on the 21st day of Febru 13 14 15 16 1'7 consider said request; and WHEREAS, at said hearing, upon hearing and considering all tes arguments, if any, of all persons desiring to be heard, said considered all factors relating to the Discussion Item; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anning Corn1 18 19 foll ows: I A) That the above recitations are true and correct. 20 B) That based on the evidence presented at the hearing, the 21 APPROVES DI 89-7 for PUD-105, based on the following fi subject to the following conditions: 22 23 1. The project is consistent with the City's General Plan since t 24 density of 2.24 du's/acre is within the density range of 0-1 25 specified for the site as indicated on the Land Use Elem development since the site is adequate in size and shape to l 2. The P1 anning Commission has, by inclusion of an appropriate cor this project, ensured building permits will not be issued for tl unless the City Engineer determines that sewer service is avail building cannot occur within the project unless sewer seric available, and the Planning Commission is satisfied that the re( of the Public Facilities Element of the General Plan have insofar as they apply to sewer service for this project. The dedication of the 12.4 acre school site at the intersectic Raod and Ambrosia Lane is acceptable as mitigation of the existing Carlsbad Unified School District school facilities. The dedication of a 24.25 acre park site at the northern I Amborsia Lane satisfies park fee requirements, All necessary publ ic improvements have been provided or will bl as conditions of approval. The appl icant has agreed and is required by the incl usi appropriate condition to pay a public facilities fee. Perfc that contract and payment of the fee will enable this body to publ ic facil ities will be avail able concurent with need as rl the General P1 an. Assurances have been given that adequate sewer for the projel provided by the City of Carlsbad. As conditioned, the project is consistent with: (1) the d standards and design guidelines of Master Plan 177 and ti Development Ordinnace and the "Architectural Guide1 ines For Single Family Detached Units." The proposed project is compatible with the surrounding future since surrounding properties are designated for residential d on the General P1 an. The appl i cant is by condition, required to pay any increase facility fee, or new construction tax, or development fee2 agreed to abide by any additional requirements established Facil ities Management P1 an prepared pursuant to Chapter 21 Carlsbad Municipal Code. This will ensure continuted avail public facilities and will mitigate any cumulative impacts cre, project. This project is consistent with the City's Growth Management as it has been conditioned to comply with any requirements i part of the Local Facilities Management Plan for Zone 19. This project was subject to Chapter 21.95 of the Carlsbad Munic (Hillside Ordinance) and meets all the requirements of that C ensure the sensitive treatment of the City's hillside resourcc Conditions: 1. Approval is granted for PUD-105, as shown on Exhibits ''A2" - 'I! January 12, 1990, incorporated by referene and on file in the Department.
