CASE NAME: THE HAMPTONS CASE NO: PUD 89-5 WHEREAS, a verified application for certain property, to 1 A portion of Lot 1 of Rancho Agua Hedionda in the City of Carl sbad, according to map thereof No. 823 f i 1 ed November 16, 1986 known as Assessor Parcel No. 207-101-01. has been filed with the City of Carlsbad, and referred to the Commission; and WHEREAS, said verified application constitutes a request as by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 17th day of 1990, and on the 21st day of February, 1990, hold a duly noticed publi as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and conside testimony and arguments, if any, of all persons desiring to be hea Commission considered all factors relating to the Planned Unit Develc NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Cc of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the pub1 ic hearing, the Cc APPROVES PUD 89-5, based on the following findings and subjec following conditions: Findinqs: 1. The site is physically suitable for the type and density development since the site is adequate in size and shape to acc residential development at the density proposed. 3. The Planning Commission has, by inclusion of an appropriate con( this project, ensured building permits will not be issued for thr unless the City Engineer determines that sewer service is avail i building cannot occur within the project unless sewer service available, and the Planning Commission is satisfied that the reql of the Pub1 ic Faci 1 i ti es Element of the General P1 an have been e. as they apply to sewer service for this project. 4. School fees will be paid to ensure the availability of school fi in the Carlsbad School District. 5. Park-in-lieu fees are required as a condition of approval. 6. All necessary pub1 ic improvements have been provided or will be as conditions of approval. 7. The applicant has agreed and is required by the inclusio appropriate condition to pay a public facilities fee. The proposed project is consistent with the City’s P1 anned De’ Ordinance and also complies with the Design Guidelines Manual. 9. The proposed project is compatible with the surrounding future since surrounding properties are designated for multiple re development on the General P1 an. 10.
