PLANNING COMMISSION RESOLUTION NO. 2985
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT FOR
A FLOODPLAIN ENCROACHMENT ON PROPERTY GENERALLY LOCATED
ON THE SOUTH OF PARK DRIVE AND EAST OF MARINA DRIVE.
CASE NAME: THE HAMPTONS CASE NO: SUP 89-7
WHEREAS, a verified application for certain property, to \
A portion of Lot 1 of Rancho Agua Hedi onda in the City of Carl sbad, according to map thereof No. 823 filed November 16, 1986 known as Assessor Parcel No. 207-101-01.
has been filed with the City of Carlsbad, and referred to the
Commi ssi on ; and
WHEREAS, said application constitutes a request as provided
21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 17th day of
1990, and on the 21st day of February, hold a duly noticed public hc
prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considc
testimony and arguments, if any, of all persons desiring to be he;
Commission considered all factors relating to the Special Use Permit
NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anning CI
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cl
APPROVE SUP 89-7, based on the following findings and subjec
following conditions:

1. All permit requirements of Chapter 21.110 of the Carlsbad Munic
have been satisfied.
2. All other required state and federal permits have been obtained 1 3. The site is reasonably safe from flooding.

PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 21s.
February, 1990 by the following vote, to wit:

NOES : None.
ABSENT: None.
ABSTAIN: Commissioner Hall.
