HomeMy WebLinkAbout1990-03-07; Planning Commission; Resolution 29951 e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 2995 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARL5 CALIFORNIA, APPROVING A STRUCTURE RELOCATION ON PROPERTY GENEF; LOCATED ON THE NORTHWEST CORNER OF ELM AVENUE AND HIGHLAND DF CASE NAME: GARY NESSIM CASE NO.: PCD 89-6 WHEREAS, a verified appl ication for certain property to wit: Parcel #2 of Carl sbad Lands Map # 1661, Parcel Map #9739, has been filed with the City of Carl sbad and referred to tht Commission; and WHEREAS, said verified application constitutes a request as F Title 21 of the Carl sbad Municipal Code; and WHEREAS, the Planning Commission did on the 7th day of Mal consider said request; and WHEREAS, at said hearing, upon hearing and considering all tes. arguments, if any, of all persons desiring to be heard, said t considered all factors relating to the Planning Commission Determin, NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 anni ng Comn fol 1 ows : A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hea, Commission APPROVES PCD 89-6, based on the following findings a1 to the following conditions: Fi ndi nqs : 1. The house relocation, which does not propose an increase in t of units on the parcel, is consistent with the City‘s General F the proposed density of 3.3 du’s/acre is within the range of 0 - 4 du’s/acre specified for the site as indicated on Use Element of the General P1 an. 2. The site is physically suitable for the type and densit: development since the site is adequate in size and shape to ac residential development at the density proposed. Conditions: 1. Approval is granted for PCD 89-6, as shown on Exhi bi t(s) "A" - January 23, 1990, incorporated by reference and on file in th Department. Development shall occur substanti ally as shc otherwise noted in these conditions. 2. Prior to final building inspection approval and Certifi Occupancy of any other structure on the property, the relocated shall be renovated as shown in Exhi bit "B" , dated January 23 used only for accessory uses compatible with the surrounding ne pursuant to Carlsbad Municipal Code Section 21-10.010(2). The developer shall enter into an agreement to pay undergrounding of a1 1 existing overhead uti 1 i ty 1 ines a1 ong thc of the project prior to grading or building permit issuance. 4. The owner of the subject property shall execute a hold harmless regarding drainage across the adjacent property prior to appro! grading or building permit for this project. 5. The developer shall obtain the City Engineer's approval of tt improvement plans and enter into a secured agreement with thc completion of said improvements prior to issuance of any build, within this project.
