CASE NAME: LOS CUATROS CASE NO.: CT 89-34 WHEREAS, a verified application for certain property to wit: Lot 522 of La Costa Meadows Unit No. 3, in the County of San Diego, Sta California, according to map thereof No. 7076, filed in the office of the Ca Recorder of San Diego County, October 6, 1971, has been filed with the City of Carlsbad and referred to the Planning Commission WHEREAS, said verified application constitutes a request as provided by Ti Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 18th day of April, 1990, noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all te: arguments, if any, of all persons desiring to be heard, said Commission considere relating to the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissio: CT 89-34, based on the following findings and subject to the following cc Findings: 1. The Planning Commission has, by inclusion of an appropriate condition to 1 ensured that the final map will not be approved unless the City Council fin& service is available to serve the project. Water shall be provided by the Vallecitos Water District. 8. This project shall comply with all conditions and mitigation measures w' required as part of the Zone 6 Local Facilities Management Plan and any made to that Plan prior to the issuance of building permits. 9. If any condition for construction of any public improvements or facilities, or of any fees in lieu thereof, imposed by this approval or imposed by law 01 are challenged this approval shall be suspended as provided in Government 65913.5. The grading for this project is defined as "controlled grading" by Section 1 of the Carlsbad Municipal Code. Grading shall be performed under the ob; a civil engineer whose responsibility it shall be to coordinate site inspection to ensure compliance of the work with the approved grading plan, subn reports to the City Engineer and verify compliance with Chapter 11.06 of t Municipal Code. 24. No grading shall occur outside the limits of the subdivision unless a letter 0: is obtained from the owners of the affected properties. 25.
