HomeMy WebLinkAbout1990-05-02; Planning Commission; Resolution 3000x e e 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 3000 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, FINDING THAT THE PROPOSED SOUTI- AGUA HEDIONDA SEWER SYSTEM IS CONSISTENT WITH THE GENERAL PLAN. APPLICANT: CITY OF CARLSBAD CASE NO.: PCD/GPC 90-1 WHEREAS, a verified application for certain property to wit: An unimproved strip of land 102 feet wide plus slope easements fron El Camino Real to Hidden Valley Road, an unimproved strip of lanc 25 feet wide generally following an existing waterline easement withil Hidden Valley Road and an unimproved strip of land 25 feet widc crossing Macario Canyon generally parallel and immediately north c the proposed Cannon Road Bridge; all of the above located general1 south and east of the Agua Hedionda Lagoon has been filed with the City of Carlsbad and referred to the Planning Commiss WHEREAS, said verified application constitutes a request as provided by Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 2nd day of May 1990, request; and WHEREAS, at said hearing, upon hearing and considering all testimony a if any, of all person desiring to be heard, said Commission considered all factors Planning Commission Determination; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission as f A. That the foregoing recitations are true and correct. 8. That based on the evidence presented at the public hearing, tl- APPROVES PCD/GPC 90-1, based on the following findings: FINDINGS: 1. As discussed in the staff report, the proposed sewer interceptor system iml consistent with the goals and objectives of the General Plan in that: -x w a a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 a) The sewer interceptor has been "designed to preserve the unique resources in the City" by siting the sewer system outside of wetlan crossing Macario Canyon in an area already disturbed by the roa construction which is consistent with guideline D.7 of the Oper Conservation Element of the General Plan. b) The sewer interceptor has been designed so that "no portion construction shall involve filling of fresh or saltwater marsh wetland impacts to sensitive areas do occur "such impacts shall be fully mil is consistent with the Agua Hedionda Land Use Plan portion of the Program. 2. The project is consistent with the Agua Hedionda Local Coastal Program a) The road follows the alignment recommended in the Agua Hedior Plan. b) Neither the road nor the sewer line will cause any filling of wetlanc PASSED, APPROVED AND ADOPTED at a regular meeting of the Plannin! of the City of Carlsbad held on the 2nd day of May 1990 by the following vote, AYES: Chairperson Schramm, Commissioners: Schlehu McFadden, Erwin, Marcus and Hall.
