CASE NAME: GOLF HEIGHTS CASE NO.: CT 89-25 WHEREAS, a verified application for certain property to wit: Parcel one of Parcel Map 4548; a Division of Lot 1 Tract No. 74-48, M? 7915, County Recorder of San Diego County. has been filed with the City of Carlsbad and referred to the Planning Commissio: WHEREAS, said verified application constitutes a request as provided by T Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 2nd day of May, 1990, noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all tf arguments, if any, of all persons desiring to be heard, said Commission consider relating to the Tentative Tract Map and Planned Unit Development. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm DENIES WITHOUT PREJUDICE CT 89-25, based on the following finding FindinEs: 1. As discussed in the staff report, the proposed project does not comply wid building setback (5 feet from the proposed private driveway) of Development Ordinance. 2.
