A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLS
CALIFORNIA, DENYING WITHOUT PREJUDICE A TENTATIVE TRACT MAP
PLANNED UNIT DEVELOPMENT TO DEVELOP A 14 UNIT CONDOM11
PROJECT ON PROPERTY GENERALLY LOCATED ON THE NORTHSIDI
PIRINEOS WAY, ONE LOT EAST OF VIEJO CASTILLA WAY.

WHEREAS, a verified application for certain property to wit:
Parcel one of Parcel Map 4548; a Didsion of Lot 1 Tract No. 74-48, Ma]
7915, County Recorder of San Diego County.
has been filed with the City of Carlsbad and referred to the Planning Commissio~
WHEREAS, said verified application constitutes a request as provided by T
Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 2nd day of May, 1990,
noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all tc
arguments, if any, of all persons desiring to be heard, said Commission conside1
relating to the Tentative Tract Map and Planned Unit Development.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comm

1. As discussed in the staff report, the proposed project does not comply wid
building setback (5 feet from the proposed private driveway) of
Development Ordinance.
2. As discussed in the staff report, the project does not provide ac
