CASE NAME: LA CORUNA CASE NO: PUD 89-12 WHEREAS, a verified application for certain property to wit: Lot 180 of La Costa South, Unit No. 1, in the City of Carlsbad, San Diego Cor according to Map no. 6117 as recorded on June 13, 1968. has been filed with the City of Carlsbad and referred to the Planning Commission; 2 WHEREAS, said verified application constitutes a request as provided by Tit Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 6th day of June, 1990, the June, 1990, and the 9th day of July, 1990, hold a duly noticed public hearing as presc: to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all tes arguments, if any, of all persons desiring to be heard, said Commission considerel relating to the Tentative Tract Map and Planned Unit Development. The project is consistent with the City‘s General Plan. The site is physically suitable for the type and density of the development is adequate in size and shape to accommodate residential development E proposed. 3. The proposed project is consistent with the Citys Planned Development 0 also complies with the Design Guidelines Manual. 4. The Planning Commission has, by inclusion of an appropriate condition tc ensured that the final map will not be approved unless the City Council fin service is available to serve the project. In addition, the Planning Commissil a condition that a note shall be placed on the final map that building per be issued for the project unless the City Engineer determines that sev available, and building cannot occur within the project unless sewer sei available, and the Planning Commission is satisfied that the requirements Facilities Element of the General Plan have been met insofar as they ap service for this project. 5. School fees will be paid to ensure the availability of school facilities in the School District. 6. Park-in-lieu fees are required as a condition of approval. 7. This project will not cause any significant environmental impacts and Declaration has been issued by the Planning Director on April 5, 1990 and . the Planning Commission on July 9, 1990. In approving this Negative Dec Planning Commission has considered the initial study, the staff analysis, mitigation measures and any written comments received regarding the signi this project could have on the environment. 11. The applicant is by condition, required to pay any increase in public faciliq construction tax, or development fees, and has agreed to abide by an requirements established by a Local Facilities Management Plan prepared Chapter 21.90 of the Carlsbad Municipal Code. This project is consistent with the City's Growth Management Ordinance as conditioned to comply with any requirement approved as part of the LOC Management Plan for Zone 6. 13. This project was subject to Chapter 21.95 of the Carlsbad Municipal Co Ordinance) and meets all the requirements of that Chapter to ensure t treatment of the Ciws hillside resources. Conditions: 1.
