A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSI
CALIFORNIA, APPROVING THE EXTENSION OF A CONDITIONAL USE PER
ALLOWING A COMMUNITY PARK ON PROPERTY GENERALLY LOCATED
CAMINO DE LOS COCHES BETWEEN RANCHO SANTA FE ROAD ANI:
COSTA AVENUE.
CASE NAME: CITY OF CARLSBAD
CASE NO: CUP 265x1
WHEREAS, a verified application has been filed with the City of Carlsbad i
to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Til
Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
did, on the 9th day of July, 1990, hold a duly noticed public hearing to cc

Those portions of Lots 5 and 6 in Section 31, Township 12 South, Range 3 1

being in the City of Carlsbad, in the County of San Diego, State of Califor
WHEREAS, at said public hearing, upon hearing and considering all te:
arguments, if any, of all persons desiring to be heard, said Commission considere
relating to CUP 265x1.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio
of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio~
CUP 265x1, based on the following findings and subject to the following

Findings:
1. That the requested use continues to be necessary or desirable for the develop]
community, is essentially in harmony with the various elements and objectives of the 1
and is not detrimental to existing uses or to uses specifically permitted in the zone
proposed use is to be located;
2. That the site for the intended use continues to be adequate in size and shape to accol

3. That all of the yards, setbacks, walls, fences, landscaping, and other features necess

4. That the street system serving the proposed use continues to be adequate to proper
traffic generated by the proposed use,
Conditions:
1. All conditions of approval imposed upon CUP 265 as stated in Planning Commissio
2452 shall apply as conditions of approval for CUP 265x1.
2. This conditional use permit is extended for a period of ten (10) years beginning on 9
and expiring on June 12, 2000 unless subsequent extensions are approved. This co
permit shall be reviewed by the Planning Director on a yearly basis to determine if 2
of this permit have been met and that the use does not have a significant detrimenr
surrounding properties or the public health and welfare. If the Planning Director der
the use has such significant adverse impacts, the Planning Director shall recomm

after a public hearing, if it is found that the use has a significant detrimental affect on
