CASE NAME: NAVARRA CONDOMINIUMS CASE NO.: CT 89-24 WHEREAS, a verified application for certain property to wit: Lot 41 of La Costa South Unit No. 1, in the City of Carlsbad, County of San D State of California, according to Map thereof No. 6117, filed in the office c County Recorder of San Diego County, June 3,1968. has been filed with the City of Carlsbad and referred to the Planning Commission; WHEREAS, said verified application constitutes a request as provided by Ti Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 1st day of August, 1990, noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all te arguments, if any, of all persons desiring to be heard, said Commission considere relating to the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio~ A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissio~ CT 89-24, based on the following findings and subject to the following con Findings: 22 1. Approval of this request shall not excuse compliance with all sections oj Ordinance and all other applicable City ordinances in effect at time of bui issuance. 12. Approval of CT 89-24 is granted subject to the approval of CP 89-12. 13. The applicant shall provide the following note on the final map of the SUI final mylar of this development submitted to the City: "Chapter 21.90 of the Carlsbad Municipal Code establishes a Growth Manage Point for each General Plan land use designation. Development cannot excee Control Point except as provided by Chapter 21.90. The land use design: development is RH. The Growth Control Point for this designation is 19 d per nonconstrained acre. The applicant shall pay a landscape plan check and inspection fee as require 20.08.050 of the Carlsbad Municipal Code. 30.
