HomeMy WebLinkAbout1990-08-15; Planning Commission; Resolution 3068, ll e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1, PLANNING COMMISSION RESOLUTION NO. 3068 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, EXTENDING A CONDITIONAL USE PERMIT ALLOWING A RESIDENTIAL CARE FACILITY ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF PALM AVENUE BETWEEN HARDING CASE NAME: MARTIN CASE NO: CUP 247x1 WHEREAS, a verified application has been filed with the City ( STREET AND 1-5. and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as F Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, tl Commission did, on the 15th day of August, 1990, hold a duly noticed consider said application on property described as: I ~ The northeasterly 93.59 feet of Lot G and part of that portion of Lot 7 and 8 in Block B of Resubdivision of Alles Avocado Acres according to Map 2027 filed May 17, 1927. I WHEREAS, at said hearing, upon hearing and considering all tes 1 ~ arguments, if any, of all persons desiring to be heard, said Commission COI factors relating to CUP 247x1. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning ( I of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. That the requested use continues to be necessary or desirable for the de of the community, is essentially in harmony with the various ele~ objectives of the general plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be 1 2. That the site for the intended use continues to be adequate in size an accommodate the use; 3. That all of the yards, setbacks, walls, fences, landscaping, and othl necessary to adjust the requested use to existing or permitted future neighborhood will be provided and maintained; 4. This conditional use permit is extended for a period of five (5) years be March 13,1990 and expiring on March 13,1995 unless subsequent ext approved. This conditional use permit shall be reviewed by the Planni: on a yearly basis to determine if all conditions of this permit have bet that the use does not have a significant detrimental impact on s’ properties or the public health and welfare. If the Planning Director that the use has such significant adverse impacts, the Planning Dir recommend that the Planning Commission, after providing the pel opportunity to be heard, add additional conditions to mitigate the adverse impacts.
