PLANNING COMMISSION RESOLUTION NO. 3020
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A HILLSIDE DEVELOPMENT PERMIT ON
PROPERTY GENERALLY LOCATED SOUTH OF CORTE DE LA
VISTA EAST OF ALICANTE ROAD AND NORTH OF LA
COSTA GOLF COURSE.
CASE NAME: FAIRWAYS
CASE NO.: HDP 90-29
WHEREAS, a verified application for certain property to wit:
Parcel 2 of Parcel Map No. 11722, in the City
of Carlsbad, County of San Diego, according to
map thereof filed in the office of the County
Recorder of San Diego County on October 10,
1981 as file no. 81-322184 of official records,
has been filed with the City of Carlsbad and referred to the Planning Corn
WHEREAS, said verified application constitutes a request as
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 3rd day of Oct
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all te:
arguments, if any, of all persons desiring to be heard, said Commission co
factors relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 1
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the (
recommends APPROVAL of HDP 90-29, based on the following fi

Findinns:
1. That those areas of 40% slope have been identifled and new slopes o
designated as open space.
2. That the proposed project is consistent with the purpose, intent and rf
of the Hillside Ordinance.
3. That the development is consistent with the provisions of Section 21
240 of the Carlsbad Municipal Code.
4. That the site has been disturbed by previously approved grading.
5. That remedial grading which is exempted from the provisions of 'I
&dinance is necessary to stabilize the existing conditions for
development-
6. That the site is impacted by unusual geotechnical and soils conc
necessitate corrective work which results in slopes greater than 30 fec
