HomeMy WebLinkAbout1990-10-17; Planning Commission; Resolution 3128* 0 0 1 2 3 4 5 6 7 8 9 PLANNING COMMISSION RESOLUTION NO. 3128 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNED DEVELOPMENT PERMIT TO DEVELOP SIX CONDOMINIUM UNITS AND A SEAWALL ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF THE INTERSECTION OF OCEAN STREET AND GRAND AVENUE. CASE NAME: ST. The site is physically suitable for the type and density of the development since adequate in size and shape to accommodate residential development at tl proposed. 3. This project will not cause any significant environmental impacts and a C Negative Declaration has been issued by the Planning Director on July 10, Approved by the Planning Commission on October 17,1990. In approving this C Negative Declaration the Planning Commission has considered the initial studj analysis, all required mitigation measures and any written comments received reg significant effects this project could have on the environment. 12. The applicant is by condition, required to pay any increase in public facility ff construction tax, or development fees, and has agreed to abide by any requirements established by a Local Facilities Management Plan prepared PI Chapter 21.90 of the Carlsbad Municipal Code. This project is consistent with the City's Growth Management Ordinance as it conditioned to comply with any requirement approved as part of the Local Management Plan for Zone 1. 14. This project was subject to Chapter 21.95 of the Carlsbad Municipal Codt Ordinance) and meets all the requirements of that Chapter to ensure the sensitive of the City's hillside resources. 5 6 7 Conditions: 1. Approval is granted for PUD 90-11, as shown on Exhibit(s) "A" - "K", dated 0 1990, incorporated by reference and on file in the Planning Department. The developer shall provide the City with a reproducible 24" x 36", mylar copy Plan as approved by the Planning Commission. The Site Plan shall reflect the of approval by the City. This project is approved upon the express condition that building permits will no for development of the subject property unless the City Engineer determines : facilities are available at the time of application for such sewer permits and wil to be available until time of occupancy. 4. This project is also approved under the express condition that the applicant pay facilities fee adopted by the City Council on July 28, 1987 and as amended frc time, and any development fees established by the City Council pursuant to Cha of the Carlsbad Municipal Code or other ordinance adopted to implement management system or facilities and improvement plan and to fulfill the SI agreement to pay the public facilities fee dated March 28, 1990, a copy of whicl with the City Clerk and is incorporated by this reference. Prior to final occupancy, a letter from a California licensed landscape architec submitted to the Planning Director certifying that all landscaping has been in 3 shown on the approved landscape plans. 4 6 5 22. The applicant shall pay a landscape plan check and inspection fee as required I 7 20.08.050 of the Carlsbad Municipal Code. 23. The first set of landscape and irrigation plans submitted shall include build improvement plans and grading plans. 24. All landscape and irrigation plans shall show existing and proposed contours 8 match the grading plans in terms of scale and location of improvements. 9 25.
