PLANNING COMMISSION RESOLUTION NO. 3156
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A SPECIAL USE PERMIT TO ALLOW CONSTRUCTION
OF AN 11,500 SQUARE FOOT LAUNDRY FACILITY WITHIN THE SAN MARCOS
CREEK FLOODPLAIN ON PROPERTY GENERALLY LOCATED ALONG THE
SOUTHWESTERN BOUNDARY OF THE LA COSTA HOTEL & SPA.

WHEREAS, a verified application for certain property to wit:
A Parcel of land being a portion of Lot 14, Section 35, Township 12 South, Range
4 West, San Bernardino Meridian in that City of Carlsbad, in the County of San
Diego, State of California, according to the official plot.
has been filed with the City of Carlsbad, and referred to the Planning Commission; and
WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad
Municipal Code: and I

WHEREAS, the Planning Commission did on the 7th day of November, 1990, hold a duly i

noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Special Use Permit and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City

of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission APPROVES

SUP 90-10, based on the following findings and subject to the following conditions:
Findings:
1. All permit requirements of Chapter 21.100 of the Carlsbad Municipal Code have been
satisfied.
2. No other required state and federal permits are required.
3. The site is reasonably safe from flooding.

1. Approval is granted for SUP 90-10, as shown on Exhiiit(s) "A" - "D", datec
November 7, 1990, incorporated by reference and on file in the Planning Departmen1

2. The existing parking area located to the south of the proposed project shall be resurface< and striped prior to issuance of a certificate of Occupancy.
3. The applicant shall prepare a detailed landscape and irrigation plan which shall bc
submitted to and approved by the Planning Director prior to the issuance of grading 0:

4. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants
(see Landscape Guidelines Manual) shall be limited to areas of special visual importance
or high use. Mulches shall be used and irrigation equipment and design shall promote
water conservation.
5. The developer shall avoid trees that have invasive root systems, produce excessive litter

6. Prior to final occupancy, a letter from a California licensed landscape architect shall be
submitted to the Planning Director certifying that all landscaping has been installed as
shown on the approved landscape plans.

7. The applicant shall pay a landscape plan check and inspection fee as required by Section

20.08.050 of the Carlsbad Municipal Code.
8. The first set of landscape and irrigation plans submitted shall include building plans,
improvement plans and grading plans.

15. Pretreatment of the sanitary sewer discharge from this project may be required. In
addition to the requirements for a sewer connection permit the developer shall conform
to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall
apply for an industrial waste water discharge permit concurrently with the building permit
for this project. No Certificates of Occupancy for the project will be issued before the
industrial waste discharge permit application requirements have been met, all applicable
fees paid and permit issued.
16. Additional drainage easements and drainage structures shall be provided or installed prior
, to the issuance of grading or building permit as may be required by the City Engineer.

17. Based upon a review of the proposed grading and the grading quantities shown on the site
plan, a grading permit for this project is required. Prior to issuance of a building permit,
for the project, the applicant must submit and receive approval for grading plans in'
accordance with City codes and standards, be issued a grading permit and complete the
grading work in substantial conformance with the approved grading plans.
18. The developer shall obtain a grading permit prior to the commencement of any clearing
or grading of the site.

22. Prior to the issuance of a grading permit or a building permit, whichever occurs first, the
developer shall enter into a future improvement agreement for the design and construction
of improvements on El Camino Real and La Costa Avenue as follows:

Any or all of the above improvements shall be constructed at such time as required by the
City Engineer.
23. Prior to issuance of a grading or building permit, the developer shall submit an executed
easement document to the City for necessary hardware installation of the traffic signal on

24. The entire potable and non-potable water systems for subject project be evaluated in detail to ensure that adequate capacity and pressure for domestic, landscaping and fire flow
demands are met.
25. The developer's engineer shall schedule a meeting with the District Engineer and City Fire
Marshal and review the preliminary water system layout prior to preparation of the water
system improvement plans.
26. The Developer will be responsible for all fees and deposits plays the major facility charge
will be collected at time of issuance of building pennit.
Fire Conditions:
27. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department.
28. Additional public and/or on site fire hydrants shall be provided if deemed necessary by the
Fire Marshal.
29. The applicant shall submit two (2) copies of a site plan showing locations of existing and
proposed fire hydrants and on site roads and drives to the Fire Marshal for approval.
30. An all weather access road shall be maintained throughout construction.
31. AU required fire hydrants, water mains and appurtenances shall be operational prior to
combustible building materials being located ont he project site.
32. AU fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval
prior to construction.
33. Building exceeding 10,000 square feet aggregate floor area shall be sprinklered.
