APPLICANT: AVIARA LAND ASSOCIATES DECLARATION FOR A CONDITIONAL USE PERMIT TO ALLOW CASE NO.: CUP 90-7 WHEREAS, the Planning Commission did on the 7th day of November, 1990, hold a duly noticed public hearing as prescribed by law to consider said request, and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, examining the initial study, analyzing the information submitted by staff, and considering any written comments received, the Planning Commission considered all factors relating to the Negative Declaration. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Planning Commission hereby recommends APPROVAL of the Negative Declaration according to Exhibit "ND", 1 dated October 4, 1990, and "PII", dated September 26, 1990, attached hereto and made a part hereof, based on the following findings: ~ Findings : 1. The initial study shows that there is no substantial evidence that the project may have a significant impact on the environment. 2. The site has been previously graded pursuant to an earlier environmental analysis. 3. The streets are adequate in size to handle traffic generated by the proposed project. 4. The City of Carlsbad has conducted an environmental review of the above described project pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, a Negative Declaration (declaration that the project will not have a significant impact on the environment) is hereby issued for the subject project. Does the project have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly? - X X - X - - X - - -5- XJSSION OF ENVIRONMENTAL EVALUATION project involves grading and construction for a 3,500 square foot building to be used as a temporary sales :e for the Aviara Master Plan Area. The site area (Planning Area 23 of the Aviara Master Plan) is 20.148 1s and construction will require a balanced grading volume of 7,000 cubic yards. Access will be taken off 2e future alignment of Blackrail Court and the site will include a paved parking lot, landscaping and a er feature. The application is a Conditional Use Permit and, as such, the proposed project would be ewed annually for compatibility. sical Environmen,t No unstable earth conditions will result as the site is already pregraded and the soils reports show no geologic instability. The proposed change to the existing pregraded site is minor in nature; there will be no appreciable change to topography. Erosion will be controlled during grading and operation of the facility and no significant drainage will flow from the adjacent agricultural lands. Since no natural drainage feature occurs on site, no modification of a natural watercourse or deposition mechanism will occur. While construc:tion will produce some incremental increase in air pollutants, this temporary increase is considered insignificant. Addition of landscaping and water features to the currently graded and barren site will change the moisture balance of the site but this incremental change is considered insignificant. As stated in item 4 above, no natural watercourse exist on site. While the project will require some water for construction and operation, there will be no impacts related to this incremental increase in need. Construction a.nd operation of the sales office will produce an incremental increase in the consumption of natural resources; this increase is considered insignificant. No significant natural resources exist on site. See item 9 above. As stated in the Environmental Impact Report for the Pacific Rim Country Club and Resort Master Plan, no significant archeological or historical resources exist on site. loaical Environment The site is currently graded and no significant habitats or species of flora and fauna currently exist. -6- '' b 0 CUSSION OF ENVIRONMENTAL, EVALUATION (cont'd] The development of the site will involve planting of shrubs, trees and turf, however, this will not affect the surrounding pregraded vacant lands nor the agricultural lands to the north. No agricultural crops or farmland exist within the boundaries of the project site. As discussed in item 12 above, the site is currently disturbed by previously approved grading and no significant species of flora or fauna currently exist. The project does not propose the introduction of any animal species and does not present a bamer to migration of such. nan Environment The project is consistent with the planned land use for the site which allows commercial uses. The project will be conditioned to pay public facilities fees and, as such, will not substantially affect any public services. All sewer systems and waste control systems required for the project are currently in place as part of the Aviara Master Plan. Construction and operation of the sales office will produce an incremental increase in noise levels but this is considered insignificant. The sales office will be closed at night and no significant exterior lighting is proposed. As such, no light or glare impacts are anticipated. No hazardous or explosive substances are proposed to exist on site, therefore no substantial risk will occur. The sales office is not a residential use and will therefore not alter the density of human population for the area. Since this project will not create a large employment base or provide housing, it will have no affect on the existing housing situation. The proposed average daily traffic of 100 trips is not considered a significant traffic generation source. All parking demands produced by the sales office will be accommodated on site and no existing parking facilities exist on site. As stated in item 25 above, all circulation systems are adequate to accommodate the traffic generated, and no movement of people or goods will be affected. -7- 0 ASCUSSION OF ENVIRONMENTAL EVALUATION (cont'dl !8. No waterborne, rail or air traffic currently travel across or near the site, therefore no affect to these transportation systems is anticipated. 19. The site is located off of Alga Road and all necessary motor vehicle and pedestrian access routes an being provided. No impacts are anticipated. 30. No emergency response or evacuation plans involve this site, therefore no impacts to such an anticipated. 31. The building will be set back from all tops of slopes and will not block any scenic vistas. The buildin design is consistent with the remainder of the Master Plan area and no impacts are anticipated. 32. BY providkg a recreational vehicle storage site, the project actually increases the quantity and qualir of recreational opportunities. No adverse impacts will occur. 33. The site is pregraded and designated for the proposed land use. No adverse impacts to plant or anim life, historical features, or habitats are anticipated. 34. Since the sales office will be temporary and development is consistent with the applicable EIR for ti Master Plan Area, no long tern environmental goals will be compromised. 35. The proposed project is proposed on a site previously disturbed by approved grading and does n propose any land uses that are inconsistent with either the Master Plan or General Plan. No cumulati affects will occur. 36. No direct or indirect adverse impacts to human beings will occur since the project is consistent with i applicable ordinances. -8- -\ 0 0 4LYSTS OF VIABLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS: a) Phased development of the project, b) alternate site designs, c) alternate scale of development, d) alternate uses for the site, e) development at some future time rather than now, f) alternate sites for the proposed, and g) no project alternative. a) The project is one building and cannot be phased, b) The proposed site design minimizes the amount of grading needed to install the sales office. c) The project is one building and therefore development cannot be scaled down. d) The project is a Conditional Use Permit and will allow the proposed use for a limited time. Since the site is designated for commercial uses, no other use would provide superior results. e) The recreation vehicle site must be developed prior to occupancy of any dwelling units within the Aviara Master Plan and the sales office is required now to sell these units. f> . This site is the only general commercial and RV storage site within the Master Plan. g) The no project alternative will halt sale and occupancy of 'surrounding planned residential uses. -9- a W IETERMINATION (To Be Completed By The Planning Department) On the basis of this initial evaluation: - X I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATM DECLARATION will be prepared. - I find that ,although the proposed project could have a significant effect on the environment, there wil not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A Conditional Negative Declaration will be proposed. - I find the proposed project MAY have a significant effect on the environment, and an ENVIRONMENTA IMPACT REPORT is required.
