CASE NAME: YAZDI CONDOS CASE NO.: CT 90-1/PUD 90-1/SDP 90-2 7 WHEREAS, the Planning Commission did on the 5th day of December, 8 and 9 1990, hold a duly noticed public hearing as prescribed by law to consider said request, 10 WHEREAS, at said public hearing, upon hearing and considering all 'I. 11 testimony and arguments, examining the initial study, analyzing the information 12 13 14 15 16 A) That the foregoing recitations are true and correct. 1'7 as follows: l8 B) Thar based on the evidence presented at the public hearing, the Planning "ND", dated June 28, 1990, and "PII", dated June 19, 1990, attached hereto and conditions: submitted by staff, and considering any written comments received, the Planning Commission considered all factors relating to the Mitigated Negative Declaration. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission 19 made a part hereof, based on the following findings and subject to the following 20 Commission APPROVES the Mitigated Negative Declaration according to Exhibit 21 22 // Findinns: 23 1. The initial study shows that the proposed project could have a significant impact because mitigation measures described in the initial study have been added to the 24 on the environment; however, there will not be a significant impact in this case 25 project. 26 2. Prior to issuance of a building permit, the Building Director shall review the architectural plans to ensure compliance with the City of Carlsbad interior noise standard of 45 &(A) CNEL. At that time, any additional measures (thicker glazing, sound absorption material, or shielding of vents) to further attenuate the noise to an acceptable level shall be required. Interior noise levels shall be mitigated to 45 &(A) CNEL when openings to the exterior of the dwelling units are closed. The City of Carlsbad has conducted an environmental review of the above described project pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. This ecklist identifies any physical, biological and human factors that might be impacted by the proposed lject and provides the City with information to use as the basis for deciding whether to prepare an .vironmental Impact Report or Negative Declaration. A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or any of its aspects may cause a significant dfect on the environment. On the checklist, "NO" will be checked to indicate this determination. An EIR must be prepared if the City determines that there is substantial evidence that any aspect of the project may cause a sinnificant effect on the environment. The project may qualify for a Negative Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed insimificant. Residential development for this site is planned for in 2 City's General Plan, as well as the Zone 1 Local Facilities Management Plan, therefore the above mtioned impacts to physical resources have been anticipated and planned for. e site has been previously used as a paved parking area, therefore no cultural resource impacts are ticipated. An acoustical study was completed which indicated that a tion of dwelling unit 1 would be subjected to exterior noise levels of CNEL 57.9 dB(A) thus creating an :rior noise level of CNEL 46.2 dB(A) in a bedroom located on the second floor. As a result of the uficant interior noise level impacts, mitigation will be required that sound attenuates the noise to an .ptable level of CNEL 45 dB(A) for all impacted interior areas of the dwelling units. -7- w lALYSIS OF VIABLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS: a) Phased development of the project, b) alternate site designs, c) alternate scale of development, d) alternate uses for the site, e) development at some future time rather than now, f) alternate sites for the proposed, and g) no project alternative. The small nature of this six unit multi-family subdivision located on a level and disturbed lot prohibits any phased development and the project does not lend itself to alternative site design or scale of development. This is an infill development, the property is zoned for residential uses, and the project conforms to the adopted residential density for the area, therefore alternative uses or alternative sites are not appropriate in this case. Development of the site at some future time or the no project alternative is not a viable solution because the area is zoned for the use and delay only postpones the inevitable development of the site. -8- w ITERMINATION (To Be Completed By The Planning Department) On the basis of this initial evaluation: - I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. 5_ I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project.
