CASE NAME: CITY OF CAIUSBAD CASE NO: CUP 90-13 WHEREAS, a verified application has been filed with the City of Carlsbad an referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 2 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin Commission did, on the 20th day of February, 1991, hold a duly noticed public hearin to consider said application on property described as: Portion of Lot B, Map 823, Rancho Agua Hedionda WHEREAS, at said public hearing, upon hearing and considering all testimony an( arguments, if any, of all persons desiring to be heard, said Commission considered a1 factors relating to CUP 90-13. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of thl City of Carlsbad as follows: I A) That the foregoing recitations are true and correct. ' B) That based on the evidence presented at the public hearing, the CommissioI APPROVES CUP 90-13, based on the following findings and subject to thc ~ following conditions: I ... I ... That the requested use is necessary or desirable for the development of tl. community, is essentially in harmony with the various elements and objectives t the general plan because it promotes the health, safety, and welfare of d along streets and intersections in residential neighborhoods; and is not detriment; to existing uses or to uses specifically permitted in the zone in which the propose use is to be located because existing surrounding uses are similar in use to tl proposed use; community by addressing the problem of documented workers seeking employma 2. That the site for the intended use is adequate in size and shape to accommodal the use since its large triangular shape provides adequate frontage allowing sai ingress and egress and adequate area for the proposed project with the majoril of parcel remaining undisturbed. 3. That all of the yards, setbacks, walls, fences, landscaping, and other featun necessary to adjust the requested use to existing or permitted future uses in th neighborhood will be provided and maintained; 4. That the street system serving the proposed use is adequate to properly handle a tr&c generated by the proposed use since the county owned and maintained ma providing access to the hiring center is minimally used, and the proposed use wi generate little additional traffic. Conditions: 1. Approval is granted for CUP 90-13 for two (2) years, as shown on Exhibit(s) "P and "B", dated February 20, 1991, incorporated by reference and on file in thl Planning Department. Development shall occur substantially as shown unles otherwise noted in these conditions. 2. This conditional use permit is granted for a period of 2 years. This conditional us permit shall be reviewed by the Planning Director on a yearly basis to determin if all conditions of this permit have been met and that the use does not have significant detrimental impact on surrounding properties or the public health an welfare. Staff will return to the Planning Commission in one year with a repol detailing these findings. If the Planning Director determines that the use has suc: significant adverse impacts, the Planning Director shall recommend that th Planning Commission, after providing the permittee the opportunity to be heart add additional conditions to mitigate the significant adverse impacts. This ped may be extended for a reasonable period of time not to exceed 5 years up01 expiration date. In granting such extension, the Planning Commission shall fin that no substantial adverse affect on surrounding land uses or the public's healtl and welfare will result because of the continuation of the permitted use. "NO Parking" signs shall be installed per City standards along the east side of th County access road between Faraday Avenue and El Camino Real. 5. A fifth parking space shall be added along the southern property line. The thre parking spaces closest to the trailer shall be designated for hiring center employe parking only. 6. The site shall be maintained so that it is free of trash and debris prior to dosh, each day. 7.
