HomeMy WebLinkAbout1991-02-20; Planning Commission; Resolution 3199*- I- I I1 e * 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 3199 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, FINDING THAT THE SUBSTITUTION OF A SOLID WALL IN PLACE OF A WROUGHT IRON FENCE IS MINOR IN NATURE AND DOES NOT CONSTITUTE A MAJOR AMENDMENT TO AN APPROVED PLANNED DEVELOPMENT LOCATED ON THE SOUTHEAST CORNER OF PARK DRIVE AND LAGUNA SHORES DRIVE. CASE NAME: LAGUNA SHORES CASE NO.: CT 88-1/PUD 88-1(A) 8 fence along the frontage of PUD 88-1 has been submitted to the Planning Commission; an 9 WHEREAS, a request to substitute a solid wall in place of a wrought iro 10 WHEREAS, Section 21.45.1 60 of the Planned Development Ordinance allov 'I. )I the Planning Commission to determine whether proposed modifications to approved plan 12 II ~~ 11 are minor in nature and do not require a formal, major amendment of the approved plan: 13 1411 and 15 WHEREAS, on February 20, 1991 the Planning Commission considered th 16 request for the material substitution for the wrought iron fence; and 17 18 WHEREAS, after considering all information regarding this item and hearinl all testimony, if any, said Commission considered all factors relating to the request. 19 i 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio~ 21 jl as follows: 22 24 B) That it is the responsibility of the applicant to secure any approvals required fror 23 A) That the above recitations are true and correct. the California Coastal Commission. 25 €3) That based on the evidence presented at the public hearing, the Commission fi& that the request is minor in nature and hereby directs the Planning Director tc 26 modify the original approved plans to show the substitution of a solid waU for i wrought iron fence along the project's frontage on Park Drive; and subject to tht 27 following conditions: 28 ..... .- - c 4 1 2 3 4 e 0 Conditions: 1. That additional vines and landscaping shall be planted adjacent to the wall. , detailed landscaping plan shall be submitted for review and approval of the Plannin Director within 30 days of the date of this decision. Approved landscaping shall b planted within 30 days of the date of the Planning Director approval of the detaile landscaping plan. 5 2. The Planning Director shall investigate the possibility of replacing the double gal on Park Drive with a solid wall. 6 7 PASSED, APPROVED, AND ADOPTED at a regular meeting of the Plannin 8 I/ Commission of the City of Carlsbad, California, held on the 20th day of February, 1991 9 by the following vote, to wit: // 10 11 12 // AYES: Chairperson Holmes, Commissioners: Schlehuber, Schramn McFadden, Erwin, Marcus & Hall.
