PLANNING COMMISSION RESOLUTION NO. 3197
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL
USE PERMIT AMENDMENT TO DEVELOP A 170 UNIT
SENIOR CITIZEN PROFESSIONAL, CARE FACILITY IN
CONFORMANCE WITH THE EL WINO REAL CORRIDOR
DEVELOPMENT STANDARDS ON PROPERTY GENERALLY
LOCATED ON THE SOUTHWEST CORNER OF EL CAMINO
REAL AND ALGA ROAD.

Lot 1 of Carlsbad Tract 72-34 (Rancho La Cuesta) Unit No.
1, in the City of Carlsbad, County of San Diego, State of
California, according to Map thereof No. 8350, as recorded in
the office of the County Recorder of San Diego County dated
July 28, 1976

hold a duly noticed public hearing as prescribed by law to consider said request; and l7
WHEREAS, the Planning Commission did on the 6th day of March, 1991, 16
the Carlsbad Municipal Code; and
WHEREAS, said application constitutes a request as provided by Title 21 of

20 il testimony and arguments, if any, of all persons desiring to be heard, said Commission

B) That based on the evidence presented at the public hearing, the Commission
26 APPROVED SUP 89-5(A), based on the following findings and subject to the

Fhdinm:
1. The project enhances the scenic qualities of the El Camino Real Corridor consistent
with the corridor's development standards by providing an attractive development
reflecting an "Old california/Hispanic" architectural theme, forty-five foot building
setbacks along El Camino Real, and landscaping which incorporates the theme
trees for the corridor.
2. The project protects scenic views and traffic safety along El Camino Real by
providing attractive buildings within extensively landscaped grounds and by
contributing to a landscaped median in El Camino Real.
3. The Planning Commission has, by inclusion of an appropriate condition to this
project, ensured building permits will not be issued for the project unless the City
Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains avallable, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of
the General Plan have been met insofar as they apply to sewer service for this
project.
4. All necessary public improvements have been provided or will be required as
conditions of approval.
5. The applicant has agreed and is required by the inclusion of an appropriate
condition to pay a public facilities fee. Performance of that contract and payment
of the fee will enable this body to find that public facilities will be available
concurrent with need as required by the General Plan.
6. The proposed project is compatible with the surrounding future land uses since
surrounding properties are designated for residential and commercial development on the General Plan.
7. This project will not cause any significant environmental impacts and a Conditional
Negative Declaration has been issued by the Planning Director on January 10,
1991 and APPROVED by the Planning Commission on March 6, 1991. In
approving this Conditional Negative Declaration the Planning Commission has
considered the initial study, the staff analysis, all required mitigation measures and
any written comments received regarding the significant effects this project could
have on the environment.

8. The applicant is by condition, required to pay any increase in public facility fe
or new construction tax, or development fees, and has agreed to abide by a1
additional requirements established by a Local Facilities Management P1;
prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This w
ensure continued availability of public facilities and will mitigate any curnulati7
impacts created by the project.
9. This project is consistent with the City's Growth Management Ordinance as it hl
been conditioned to comply with any requirement approved as part of the Loc
Facilities Management Plan for Zone 6.
Conditions:
1. Approval is granted for SUP 89-5(A), as shown on Exhibit(s) "A" - "St, dated Marc
6, 1991, incorporated by reference and on file in the Planning Departmen
Development shall occur substantially as shown unless otherwise noted in the:
conditions.
2. Approval of SUP 89-5(A) is granted subject to the approval of CUP 88-21 (A).
3. The conditions of City Council Resolution 90-55 for SUP 89-5, dated March 1:
